BASIC RULES OF PARLIAMENTARY PROCEDURE


I. Origin of Parliamentary Rules
It was originally systematized in ancient English Parliament .

II. Objectives
1. It helps carry out the legislative body’s objectives effectively
2. It simplifies & systematizes the conduct of business
3. It enables the legislative assembly (Sanggunian) to make fast
& valid decisions
4. It maintains decorum for smooth transaction of business
5. It determines the will of the majority
6. It reconciles conflicting opinions of members

BASIC RULES OF PARLIAMENTARY PROCEDURE


III. Ten Tenets of Parliamentary Procedure
1. Rule of the majority to be observed/followed
2. Right of minority to be heard
3. Equality of rights, privileges, and obligations of each member
4. There must be a presiding officer who is neutral
5. Full and free discussion and debate must be encouraged
6. Singularity of subject or topic
7. Generally, motions must be submitted to a vote
8. Group interest must prevail
9. Respect for the freedom of speech
10. Respect for the human dignity

Rule 1. Sangguniang Barangay Internal Rules.
 should adopt its own Internal Rules which serve as their guide
in the conduct of their sessions.
 Two methods on how to formulate Sangguniang Barangay
Internal Procedures:
 a)By enactment of a Barangay Ordinance- “An Ordinance Enacting
the Internal Rules of Procedure of the Sangguniang Barangay of
________”.

its validity.
 b) By adoption of a Barangay Resolution- “A Resolution Adopting
the Internal Rules of Procedure of the Sangguniang Barangay of
_________________.”
 Since it is done in form of a resolution, there is no need for
review by the Sangguniang Bayan/Panlungsod.

Rule 2. Composition of the Sangguniang Barangay.
The composition of the Sangguniang Barangay must be
determined. This shall be composed of:
a) Punong Barangay - as Presiding Officer
b) 7 Barangay Kagawads - as Members
c) SK Chairman - as Ex-Officio Member
 The Barangay Secretary - as the Records Officer.
 Two (2) officials of the Sangguniang Barangay - (a) the
Presiding Officer and the (b) Barangay Secretary.
 Since the members of the Sangguniang Barangay are non-
partisan, there is no such majority and minority floor
leaders.

Rule 3. Quorum Determination.

QUORUM is more than half (5) from among the 9 members who are not
legally or physically impaired from attending the session. The following
are examples of :

Rule 3. Quorum Determination.

ABSENT classified into two:


i - Justified absence - as provided for by law, such as:
(a) On Official Business (O. B.)
(b) On Vacation or Sick Leave
ii- Unjustified/ Unauthorized absence - due to neglect of duty,
tardiness .The absent sangguniang barangay member shall face two
consequences:
(a) he is subject for a fine or penalty, as provided for under the
Sangguniang Barangay Internal Rules.

Rule 3. Quorum
Determination.
(b) his honorarium can validly be withheld proportionate to the number of
sessions held in a month on the following reasons:
i - the Sangguniang Barangay members are paid in the form of
honorarium
ii - honorarium is a remuneration given to a public official for services
actually rendered (Government Accounting and Auditing Manual –
GAAM)
iii - honorarium is something given not as a matter of obligation but in
appreciation for services rendered as voluntary donation in
consideration of services which admit of no compensation of money
(Santiago vs. COA, GR 92284, July 12, 1991)
iv - the grant of honorarium is based principally on services actually
rendered by the claimant thereof, and the most convenient way of
measuring the services rendered by a Sangguniang Barangay member
is attendance in sessions. (DILG Opinion No. 2, s. 2010)

Rule 4. Agenda/Order of Business.

“Agenda” is the common terminology of

1) Physically and Mentally Present (PMP)

Rule 30. Immediate Approval Rule.


Reasons for the adoption of the Immediate Approval Rule:
(a) The three-reading principle is a parliamentary procedure.
(b) The purpose of 3-reading rule is for the concerned committee of the
sangguniang barangay to study deeper and introduce amendments or
improvements of the proposed ordinance, to be well-deliberated or
amended during the second reading.
(c) The “urgency” of the proposed legislative measure can be defeated if the
3-reading rule be religiously followed, as it would take at least four (4)
regular sessions comprising two months legislative process in the
sangguniang barangay , such as: first reading, committee report, second
reading, and third reading on separate sessions.
(d) The immediate approval of a proposed barangay ordinance can be done
either under one reading or three readings in one session day.

Rule 33. Interpellations.

Rule 35. Motions


2) As to General Purpose
(1) Main Motions – are those subjects or ideas proposed to be
considered by the body, presented in the affirmative statement.
Example: “I move for the approval of Proposed Ordinance No.10, series of
2010, An ordinance penalizing gambling activities in the barangay.”
(2) Subsidiary Motions - those motions designed to modify or dispose of,
temporarily or permanently a main motion pending before the body.
(3)Privilege Motions - are those designed to meet the urgent needs of the body
which has the highest precedence over all kinds of motions.
(4) Incidental Motions - those which arise only incidentally out of the
pending business or proceedings of the assembly.
3) As to its debatability
(1)Undabatable Motions – those privilege motions which need not be
debated upon, viz:
a - to lay on the table
b - to call for the previous question
c - to raise a point of order
d - to raise a point of parliamentary inquiry
e - to raise a point of information

Rule 35. Motions


(2) Limited Debate Motion – a motion to postpone definitely
