BIODIVERSITY ACT, 2002 ( पार्श्ण भुमी )
सांयुक्त िाष्ट्र सांघाचे रिओ-वि-जेनेरिओ येथे वदनाां क 5 जून, 1992 िोजी
सांपन्न जैविक विविधता सम्मेलनात भाित सहभागी झाला होता.
सदि सम्मेलनात मान्य किण्यात आले –
1. स्थावनक िाज्याचे तेथील जैविक विविधता सांसाधनािि मुलभूत हक्क ,
2. त्ाां चे सांिधमन,
3. जैविक सांसाधनाां चा शार्श्त उपयोग,
4. अशा सांसाधनाचा व्यिसावयक उपयोग होत असल्यास, त्ापासून वमळिाऱ्या
फायद्यामध्ये स्थावनकाां चा न्याय / समन्यायी वहस्सा
त्ा अनुषांगाने त्ाची न्यावयक व्यिस्था किण्यासाठी भाितीय गििाज्याने “
जैववक ववववधता कायिा, 2002 ” पारित केलेला आहे .

• Prior to CBD, bioresources were considered common heritage of mankind
and were exchanged freely.
• The country providing raw material for developing useful products
therefore never got any benefits from commercialisation of those
products.
• As the situation was perceived to be inequitable, especially by the
biodiversity richcountries, ABS concept was introduced in CBD.
• The common heritage of mankind concept has evolved into a much more
complex but equitable model of sovereign rights over GRs and ABS.
• ABS has to be operationalised through national legislation.
• Access to GRs is to be subject to prior informed consent of the provider
country. Users and providers to have bilateral agreement on mutually
agreed terms (MAT) on sharing of benefits that may arise from use of GRs.

ABS case studies
• The recognizing TK of the San people: The Hoodia gordonii case of Benefit Sharing
• Argan (Argania Spinosa)-Moorocco case
India ABS cases
1. Seaweed (TN): Pepsico India Pvt. Ltd
2. Neem Leaves case: Bio Inida Biologicals Company exported 2000Kg neem leaves to
Japan
3. Ongole bull embryos: Brazilian firm (Rs 1.2 crore)
4. TBGRI scientists understood secret of Kani tribals Arogyapacha use in 1987 in
Kerala.
• Drug was developed named ‘Jeevani’ by AryaVaiday Shala and TBGRI.
• 50% of the royalty was shared with Kanis by forming Charitable Trust.
• The process started prior to CBD due to conscious of the scientists working with
the tribe.
AFTER BD ACT 2002
Ongole cattle case from Telangana State
• Brazilian beef and dairy industry applied NBA to access cattle embryo of ongole bull
for research to upgrade cattle breeding in Brazil.
• NBA ordered the company to pay Rs.1.20 crore upfront payment.
Examples of Implemented ABS
Agreements
• PepsiCo exported 2000 MT seaweed to Malaysia, Philippines and
• Indonesia. The seaweed is grown by fisherman community in Tamil Nadu.
• They were given training by the company. The NBA was paid royalty @ 5%
amounting to Rs. 3.9 million by the exporter
• Due to claims that this seaweed is becoming an invasive species, NBA has now
stopped providing access permits.
Examples
• Natural Remedies Pvt. Ltd, Bengaluru, purchased Kalmegh (Andrographis
paniculata), a medicinal herb, from BMC of Malajkhand Balaghat district MP.
• They paid Rs. 21,000 directly BMC

To biological resources, normally traded as commodities notified by the Central Government under section 40
of the Act. Notification Dt. 07.04.2016,(385 items) Notification Dt. 07.11.2017 (386 to 421 items)
To collaborative research through government-sponsored institutes subject to conformity with guidelines and
approval of the Central / State Governments.
To access value added products.(Value added products” means products which may contain portions or
extracts of plants and animals in unrecognizable and physically inseparable form)

WHAT ARE THE CONSEQUENSES OF
LACK OF COMPLIANCE OF BD ACT
In case where U/S 3,4,6 Aapproval of NBA is required for the use of Indian
Bio-logical Rresources and associated knowledge and such approval is not
obtained
1. Punishment- imprisonment which may extend to 5 yearw or with fine
which may extend 10 lakh
In case u/s 7 State Biodiversity Board needs to be intimated about the use of
Indian Biological Resources and associated knowledge – and this is not done.
1. Punishment- may extend to 3 yr. Imprisonment or fine of 5 lakh or with
both.

Benefit claimers- means the conservers of the biological resources, their byproducts,
creators and holders of knowledge and information relating to the use of such biological
resources, innovations and practices associated with such use and application.

Bio-Survey and Bio-Utilization
Means survey or collections of species Sub-Species, Gene components and extracts of Biological
resource for any purpose and includes characterization and Inventionzation and Bio-Assay.

सांशोधनासाठी, विशेष गुिधमम आवि शास्त्रीय सांशोधन किण्याची पित

COMMERCIAL UTILIZATION
Means end use of biological resource for commercial utilization such as, Drugs,
Industrial Enzymes, Food Flavors, Fragrance , Cosmetics, Emulsifiers, Oleoresins,
Colors, Extracts and Genes used for improving crops and livestock through genetic
interventions, but does not include conventional breeding or traditional practices use in
Agriculture, Horticulture , Poultry, Dairy farming ,Animal husbandry, Bee keeping.

• Provisions of the Act shall be in addition to any other law in force relating to forests or
• wildlife. (S 59).
• The offences under this Act shall be cognizable and non-bailable (S.58)
