National Defense Act of 1935

Commonwealth Act No.1:

Provides that “during national emergencies, the


government has the right to mobilize its citizens
resources, either public or private as may be
deemed necessary for national defense…’

ORGANIZATION OF AFP RESERVE FORCE
UNDER 1987 CONSTITUTION

Section 4, Article XVI


“… The Armed Forces of the Philippines shall be
composed of a Citizen Armed Force who shall
undergo military training and serve as may be
provided by law. It shall keep a regular force
necessary for the security of the State.”

REPUBLIC ACT 7077
AN ACT PROVIDING FOR THE DEVELOPMENT, ADMINISTRATION,
ORGANIZATION, TRAINING, MAINTAINANCE AND UTILIZATION OF
THE CITIZEN ARMED FORCES OF THE ARMED FORCES OF THE
PHILIPPINES AND FOR OTHER PURPOSES.

PASSED BY BOTH HOUSE OF REPRESENTATIVE AND SENATE ON


MARCH 19, 1991 AND APRIL 20, 1991 RESPECTIVELY

FINALLY APPROVED ON JUNE 27,1991

ARTICLE I
Section 1. Title. - This Act shall be known as the
“CITIZEN ARMED FORCES OF THE PHILIPPINES RESERVIST ACT”
RA 7077 PROVIDED FOR THE :

1. DEVELOPMENT
2. ADMINISTRATION
3. ORGANIZATION
4. TRAINING
5. MAINTENANCE
6. UTILIZATION
of the Citizen Armed Force to ensure their readiness
to immediately respond to the call to service.
NATIONAL POLICY:

To maintain a standing regular military


force in times of peace consonant to its
adequate and actual needs for the
security of the State but which can be
rapidly expanded by the well-disciplined
Citizen Armed Force in the event of war,
rebellion or invasion.
MISSIONS:

1. To provide the base for the expansion of the AFP in


the event of war, rebellion or invasion:

2. To assist in relief and rescue during disaster or


calamities;
3. To assist in socio-economic development, and,;

4. To assist in the operation & maintenance of essential


government or private utilities as an overall vision of
the AFP.
5 COMPONENTS

1. Air Force Reserve


2. Army Reserve
3. Navy Reserve
4. AFP-Wide Technical Reserve
5. Affiliated Reserves
MECHANICS:

 The organization of each components of the


Reserve Force and the manpower objective
shall be as prescribed by Secretary of
Department of National Defense (DND) and
approved by the President.

 The organization structure, manning and


equipment of reserve units shall conform to
the organization of the regular force.
AFFILIATED RESERVE

Certain private & government entities, corporations,


establishments, and organizations w/c take care of
essential public services such as:

1. Water (e.g. Manila Waters, Maynilad)


2. Light / Electricity (e.g. Meralco, electric coops),
3. Transportation(e.g. MRT’s, LRT’s, Bus Co, etc.)
4. Communication (e.g. Smart, Globe, etc.)

w/c are necessary to support in the implementation of


national defense plans shall be organized as affiliated
units; shall be utilized in times of war or emergency to
ensure the continuous and uninterrupted provision of the
services they are rendering.
CITIZEN SOLDIERS
alternately referred to as - RESERVISTS
 Graduates of ROTC – basic and advance courses
 Graduates of authorized Basic Military Instructions
 Ex-Servicemen/ Retired officers and
 Recognized WWII guerillas (honorably discharged)
 Commissioned & NCO under affiliated Reserves
 NDCP graduates
 Commissioned & NCO under the existing laws
 and those procured under projects 36-70 and included
in the present AFP roster before the enactment of this act.
CATEGORIZATION:

1st Category - between 18 and 35 years old


2nd Category - between 36 and 51 years old
3rd Category - above 51 years of age.
CLASSIFICATIONS

1. Ready Reserve - subject to call at anytime in times of


war or national emergency, calamities, disasters and
threats to peace, order, security and stability in any
locality, and to assist in relief and rescue work and other
civil assistance activities.

2. Standby Reserve - belonging to the 2nd & 3rd


Category may be ordered to active duty only in times of
national emergencies or war.

3. Retired Reserve - provided qualified and fit for duty


may be ordered to active duty in times of local or national
emergencies.
BASIC CITIZEN MILITARY TRAINING

Registrants finally selected shall undergo a basic


military training for a period of not more than six (6)
months.
The course of instruction shall include among others:

1. MORAL VIRTUES
2. PATRIOTISM
3. DISCIPLINE
4. ADHERENCE TO THE CONSTITUTION, and
5. RESPECT FOR THE RIGHTS OF CIVILIANS.
BENEFITS FROM TRAINING:

 Reservists will be given opportunities to


update their skills through compulsory or
voluntary training. Such training shall have for
its principal purpose the enhancement of the
readiness of the reservists to respond to the
call of service.
TYPES OF TRAINING:

1. COMPULSORY TRAINING of not less than 30 days


but not more than 60 days for individual reservist or
reserve unit in a given year preferably to 1st category

2. VOLUNTARY TRAINING subject to the capability of


the AFP to provide the training. Reservists shall be
encouraged to undergo training on a voluntary basis to
upgrade their proficiency.
STATUS GIVEN WHILE ON TRAINING

 Reservist on compulsory training shall be subject


to military law. They shall not receive pay but
shall be entitled to allowances and burial
benefits as provided by law.

 Reservist on voluntary training are also subject


to military law but shall not be entitled to
allowances
WOMAN RESERVISTS:

A woman reservist shall have the right and duty


to serve in the AFP. The relevant standards for
admission, training and commissioning shall be
the same as those required for men except for
those essential adjustments because of
physiological and biological difference between
men and women.
EFFECTS OF MILITARY TRAINING ON THE SECURITY
OF TENURE IN GOVERNMENT OR PRIVATE EMPLOYMENT

In the case of private employment, payment of basic


salary during such military training shall be in
accordance with the existing laws or with company’s
policies on it’s employees on leave from his
employment.

An employee of the government who undergoes


military training shall not be separated or terminated
from such employment; shall not be considered as
having forfeited his seniority status; and shall
continue to receive the salary he was receiving prior
to the call to military training.
MOBILIZATION:

The utilization of the Reserve Force in times of


emergency to meet threats to national security
shall be through mobilization.

FULL MOBILIZATION - shall be through the joint


act of Congress and the President. All units of
the Ready and Standby reserves will be
activated and called to active duty and placed
under operational readiness.
Cont.: MOBILIZATION:

PARTIAL MOBILIZATION- shall be through the joint act of


Congress and the President. Only the units of the Ready
reserves are necessary to meet the threat will be activated
and called to active duty and placed under operational
readiness. The President will specify the units to be
activated.

SELECTIVE MOBILIZATION – shall be by authority of the


President. May be ordered to selected unit to meet a local
threat or emergency situation under such rules and
regulations as prescribed by DND Secretary.
STATUS DURING MOBILIZATION:

When called to active duty during


mobilization shall receive all the pay and
allowances, medical care, hospitalization,
and other privileges and benefits prescribed
by law or regulations for officers and enlisted
personnel of the regular force.
DEMOBILIZATION:

When the threat or emergency for


which mobilization had been ordered
has passed, the President shall order
the demobilization of the reserve units
activated and the reservists of such
deactivated units shall be reverted to
the inactive status
