ANTI-RED TAPE ACT

OF 2018 (ARTA)

Republic Act No. 11032 or the “Ease of
Doing Business and Efficient Government
Service Delivery Act of 2018”, was enacted
on May 28, 2018

Republic Act No. 11032 created the Anti-


Red Tape Authority.

The IRR of Anti-Red Tape Authority was


subsequently promulgated on August 4,
2019.
GENERAL GUIDELINES
All government agencies are directed to immediately
submit to the authority the following:
 Comprehensive list of all government services classified
into simple, complex and highly technical transactions;
 Complete requirements and fees for such services;
 Prescribed processing times of such classified
government services which in no case shall exceed the
corresponding three (3), seven (7), and twenty (20) days
under RA 11032, and;
 Where applicable, the government services that are
covered by the Constitution and special laws thereby
exempted from the processing time under RA 11032
indicating such service, prescribed processing time and
the legal basis.

Processing Time
The total processing to conclude the process shall not
exceed the maximum period of :

Three (3) days for simple transaction;


Seven (7) days for complex transaction;
Twenty (20) days for highly technical
transactions
Drafting a Citizens Charter
 Creation or Designation of Anti-Red Tape Unit (ARTU) – shall include
members thereof of the agency’s officers with planning and
administrative functions;
 Reengeneering- Reengineer systems and procedures of the
agency;
 The improved and reengineered systems and procedures of the
agency shall be the basis in drafting and updating the Citizens
Charter;
 The National Govt. Agencies (NGAs) shall ensure the alignment and
standardization of the processes of its central, regional, local and
other offices providing the same and similar services. Such aligned
and standardization processes shall be reflected in the Citizens
Charter.
TIMELINE OF SUBMISSIONS
All government agencies must submit their
initial updated Citizens Charter, together
with the Certificate of Compliance (CoC),
both duly approved and signed by the
Agency Head on or before December 6,
2019.
