The first period is characterized by the adoption of


a reactive policies:

1903 – Development of OSH in the Philippines


1908 – Employer’s Liability Act was instituted requiring
employers to compensate workers who were
injured while performing their job
1908 – DOLE started as a small Bureau (BUREAU OF
LABOR STANDARDS).
1927 – Workmen’s Compensation Act No. 3428 was passed
w/c provided payment of damages by the employer
for illnesses, in addition to injury or death due to
employment
1933 – DOLE became a Department on Dec. 8, 1933

The second period is characterized by the


adoption of pro-active measures/policies

1936 – Commonwealth Act No. 104 was passed. The first


legislation that directly enjoined mgt. to ensure
the promotion of safety & health in the workplace.
Called the First Industrial Safety Law.
1945 – Commonwealth Act No. 696 was approved to
include safety in the installation & operation of
boilers and pressure vessels.
1948 – Philippines became a member of ILO
1954 – Enactment of RA No. 1054 (Free Emergency
Medical & Dental Treatment Act)
1959 – SOPI was organized.

1967 – Proclamation No. 115-A was issued declaring the

adoption of proactive measures/policies

1974 – PD 442 otherwise known as the “Labor Code of


the Philippines” was passed.
1975 – Started the program on accreditation for safety
training organization (STO) to conduct OSH
training.
1977 – Tripartite body was created to study the proposed
OSHS
1978 – OSHS was approved. National Tripartite Committee
was created to study the improvement of the
OSHS
1984 – Tripartite consultation was held to amend OSHS.
Rule 1410 (Construction Safety) was amended
1988 – OSH Center was inaugurated, created per EO 307
(the first in Southeast Asia)

1989 – Major amendments of OSHS took place.
1998 – Tripartite Council on OSH in Construction Industry
was created.
1998 – Department Order No. 13 (Implementing
Guidelines in the Implementation of OSH in
Construction Industry) was issued.
1998 – Memorandum Circular No .02 – Guidelines for
Classifying Hazardous & Non–Hazardous
Workplaces.
1999 – ASPPI was organized. 1st Gen. Assembly &
Convention of DOLE-Accredited Safety
Professionals was held.
2000 – MC No.01–Guidelines for the Conduct of Work
Environment Assessment (WEA)

2000 – MC No. 02–Guidelines in the Application of


Workplace Component of RA 8504 known as “Phil.
AIDS Prevention & Control Act of 1998”
2001 – 1st meeting/gathering of DOLE–BWC Accredited

amendments of OSHS (Rule 1030, Rule 1160, Rule
1170, Rule 1180 & New Rule 1240)
2003 – Organization of ATOP Inc., for OSH. Renamed as
ASHTOP Inc., in 2004. And, Department Order No.
16 amending Rule 1030 of the OSHS (Training &
Accreditation of Personnel in OSH) was approved.
2004 – Department 54 – 07 (New Labor Standards
Enforcement Framework) & Department Order 53–
03 (Guidelines in the Implementation of a Drug–
Free Workplace Policy & Programs in the Private
Sector) was approved.

A set of 28 mandatory rules on OSH (about 10 are highly


technical) which codifies all safety orders issued prior to
its promulgation.
TYPES OF RULES: a) Administrative, b) Technical, c)
Medical.
Patterned after the standards of other developed
countries.
The 1st amendments was approved on August 1989 by
Sec. R. Torres.
• Enforcement of the Standards is through the 16 regional
offices of the DOLE in the different parts of the country
• The BWC exercises technical supervision over enforcement of
the Standards.
OBJECTIVES: Protection of workers against the dangers of
injury sickness or death.
SCOPE: All places of employment except land, sea & air
transportation. Safety in mines is not covered by the
Standards.

Rule 1000 – General Provision


Rule 1001 – Purpose & Scope

 The objective of this Standards is to protect every


working man against the danger of injury, sickness or
death through safe and health working conditions,
thereby assuring the conservation of valuable manpower
resources and the prevention of loss or damage to lives
and properties, consistent with national development
goals and with the state commitment for the total
development of every worker as a complete human
being.

 This Standards shall apply to all places of employment


except as otherwise provided.

Rule 1005 – Duties of Employers, Workers & Other Persons

1 Each employer covered by the provisions of this Standards


shall:
● Furnish his workers a place of employment free from
hazardous conditions.
● Give complete job safety instruction to all his workers.
● Comply with the requirements of the Standards.
● Use only approved devices & equipment in his workplace.
2 Each worker shall cooperate with the employer in carrying
out the provisions of the Standards:
● Shall report any work hazard in the workplace.
● Shall make proper use of all safeguards & safety devices
furnished for his protection & the protection of others.
● Shall follow all instructions by the employer in compliance with
the OSHS provisions
3 Any person, including any builder, contractor,
enforcement agent, who visits, builds, renovates, install
devices, or conducts business in any establishment or
workplace shall comply with the provisions of the Standards
& all regulations of employer, as well as other subsequent
issuances of the Secretary.

Rule 1020 : Registration

Free of charge & Valid for the lifetime of the


company.

Requirements:

 Lay-out plan of the workplace, floor by floor, in a scale of


1:100 meters showing all physical features of the
workplace including storage, exits, aisles, machinery,
emergency devices & location.

Reasons for Re-Registration:


 Change in name, address, owner
 Opening after previous closing

Rule 1030 – Training & Accreditation of Personnel in OSH

Rule 1031 : General Provisions:


1 The Bureau, either directly or through accredited organizations or
the OSHC or other institutions authorized by law, shall conduct
continuing programs to increase the supply & competence of
personnel qualified to carry out the provisions of these
Standards.
2 The Bureau shall prescribe the required training programs which
shall, in consultation with the OSHC or other institutions
authorized by law & other technical societies, contain provisions
requiring the incorporation into the training programs of the
latest trends, practices & technology in occupational safety &
health.

Rule 1032 : Definitions:


1 “Safety Officer” refers to any employee/worker trained & tasked
to implement OSH programs in the workplace in accordance with
the provisions of the Standards & shall be synonymous to the
term “safety man” as used in these Standards.

8 Highly Hazardous Workplace – one where the potential
hazards within the company may affect the safety and/or
health not only of workers within, but also of the persons
outside the premises of the workplace.
 Petrochemical works and refineries.
 Chemical works and chemical production plants.
 LPG storage and materials.
 Stores and distribution center for toxic/hazardous chemicals.
 Large fertilizer stores.
 Explosives factories.
 Works in which chlorine is used in bulk.
 Activities closely similar to the activities enumerated above,
and
 Activities as determined by the Bureau in accordance with
existing issuances related to classification of establishments.

Rule 1033 : Training & Personnel Complement

The minimum qualifications, duties & number of


required safety & health officers shall be as
follows:

 All Safety Officers must complete the Bureau-


prescribed training course prior to their appointment as
in their respective places of employment.
 All Full-Time (FT) Safety Officers must meet the
requirement of duly-accredited Safety Practitioners or
Safety Consultants by the Bureau.
 Not less than the following number of supervisors or
technical personnel shall take the required trainings &
shall be appointed as a safety officers on a full-time or
part-time basis, depending on the number of workers
employed & the hazardous or non-hazardous nature of
the workplace pursuant to Rule 1013 of these
Standards.

Rule 1034 : Accreditations

The Secretary, upon the recommendation of the Bureau


Director, may accredit any qualified safety and health
consulting & training organization &, through the Bureau,
may issue accreditation to any qualified safety & health
personnel, individual to carry out the provisions of these
Standards.
Any application for accreditation shall satisfy the
requirements enumerated for:
A Practitioner in OSH
B Consultant in OSH
C OSH Consulting Organization
D OSH Training Organization
Renewal of Accreditation:
Accreditation for practitioners & consultants shall be renewed every
three years upon compliance of requirements

RULE 1034.01 : Requirements for Accreditation of a


Practitioner in OSH

Any application for accreditation shall satisfy the following


requirements:
1 The individual must have completed the 40-hour BOSH training
course, as prescribed by the Bureau.
2 The individual must have, at least, three (3) years of relevant
experience in Occupational Safety & Health.
3 The individual must posses the minimum qualifications, stated
under Rule 1964.01 (#1 to #5), whichever may be applicable, and
4 The individual must be duly-licensed to practice his/her profession
in the Philippines.
5 If the applicant is a graduate of any 4- or 5-year college course
without a license, he/she must have at least four (4) years relevant
experience in any of the sub-components in a field of specialization
as enumerated in Annex “A” and
6 If the applicant is a college undergraduate, he/she must have at
least ten (10) years relevant experience in Occupational Safety &
Health.

Rule 1040 : Health & Safety Committee


Rule 1041 : General Requirements

 In every place of employment, a Health &


Safety Committee (a group of
management & employees that plans &
develops policies in all matters related to
OSH) shall be organized within one (1) month
from the date the business starts operating.

 The Health & Safety Committee shall be re-


organize every January of the following year.

RULE 1043 : Duties of the H&S Com


The Health & Safety Committee is the planning and policy
making group in all matters pertaining to Safety & Health. The
principal duties of the Health & Safety Committee are:
 Plans & develops accident prevention program for the
establishment.
 Directs the accident prevention efforts of the establishment in
accordance with the safety programs and government regulations
in order to prevent accidents from occurring in the workplace.
 Conducts safety meetings at least once a month.
 Reviews reports of inspection, accident investigations &
implementation of program.
 Submits reports to the manager on its meetings & activities.
 Provides necessary assistance to government inspecting
authorities in the proper conduct of their activities such as the
enforcement of the provisions of the Standards.
 Initiates & supervises safety training for employees.
 Develops & maintains a disaster contingency plan & organizes
such emergency service units as may be necessary to handle
disaster situations pursuant to the emergency preparedness
manual for establishments of the office of Civil Defense.

RULE 1045 : Duties of the Employers


Health & Safety Committee plays very important roles in eliminating work
hazards. Developing workers’ interest and participation in the planning and
development of safety & health program is the responsibility of the employer.
The employer must exercise the necessary leadership and provide needed
support to make the program work. The principal duties of the employer
are:
 Establishes and adopts in writing administrative policies on safety in conformity with
the provisions of this Standards outlining therein his responsibility and authority
delegated.
 Reports to the enforcing authority in two copies of the policies adopted and the health
and safety organization established to carry out the program on safety & health within
one month after the organization or reorganization of the health & safety committee.
 Reports to the enforcing authority having jurisdiction at least once a month in every
three months, counting from January, the health & safety program of the organization
outlining the activities undertaken including its safety performance, health & safety
committee meetings and its recommendations and measures taken to implement such
recommendations.
 Acts on recommended measures by the health & safety committee by adopting the
elements of the safety & health program in the production process or workplace and in
case of non-adoption of the health & safety Committee’s recommendation, to inform
the committee of his reasons.

RULE 1046 – Duties of the Workers

1 Works in accordance with accepted safety


practices & standards established by the
employer in compliance with the provisions of
the Standards.
2 Reports unsafe acts & unsafe conditions to the
supervisor by making suggestions for correction
or removal of accident hazards.
3 Serves as members of the H&S Committee.
4 Cooperates actively with the H&S Committee.
5 Assists government agencies in the conduct of
the Health & Safety inspection or other
programs.

RULE 1047 – Duties of the Safety Man


1 Serves as Secretary to the H&S Committee.
2 Acts in an advisory capacity on all matters pertaining to H&S
for the guidance of the employer & the workers.
3 Conducts investigation of accidents as member of the H&S
Committee & submits his separate report & analysis of
accidents to the employer.
4 Coordinates all H&S training programs for the employees &
employer.
5 Conducts H&S inspection as member of the committee.
6 Maintains or helps in the maintenance of an efficient accident
record system & coordinates actions taken by the supervisors
to eliminate accident causes.
7 Provides assistance to government agencies in the conduct of
S&H inspection, accident investigation or any other related
programs.
8 For purposes of effectiveness in a workplace where full-time
safety man is required, he shall report directly to employer.

Rule 1053.01 : Notification – All work accidents or occupational


illnesses, resulting in disabling conditions or dangerous occurrences
shall be reported by the employer to the Regional Labor Office

If work accidents results in death or permanent total disability, employer


shall initially notify the Regional Labor Office within 24 hours.

Rule 1054 : Keeping of Records – The employer shall maintain and


keep an accident or illness record which shall be open at all times for
inspection to authorized personnel.

Emergency Hospital – An employer need not put up


an emergency hospital or dental clinic if there is a
hospital or dental clinic which is not more than five(5)
kilometers away or which can be reached by motor
vehicle within twenty-five(25) minutes of travel and that
the employer provides transportation facilities.
