Anti-Bullying Act of 2013

(Republic Act 10627)


AN ACT REQUIRING ALL
ELEMENTARY AND SECONDARY
SCHOOLS TO ADOPT POLICIES
TO PREVENT AND ADDRESS THE
ACTS OF BULLYING IN THEIR
INSTITUTIONS
IRR of RA No. 10627

 Effectivity Jan. 3, 2014


The provisions of DepEd Order No.
40, s. 2012, or the DepEd Child
Protection Policy on bullying are
hereby deemed amended.
 All other provisions of said DepEd
Order shall remain in full force and
effect.
“Bullying” refers to any severe, or
repeated use by one or more students
of a written, verbal or electronic
expression, or a physical act or
gesture, or a combination thereof,
directed at another student that has
the effect of actually causing or
placing the latter in reasonable fear
of physical or emotional harm
or damage to his property; creating a
hostile environment at school for the
other student; infringing on the
rights of another student at school;
or materially and substantially
disrupting the education process or
the orderly operation of a school;
such as, but not limited to,
1. Any unwanted physical contact
between the bully and the victim
like pushing, punching, shoving,
kicking, slapping, tickling,
headlocks, inflicting school
pranks, teasing, fighting and the
use of available objects as
weapons;
2. Any act that cause damage to a
victim’s psyche and/or emotional
well-being
3. Any slanderous statement or
accusation;
• name-calling
• tormenting and commenting
negatively
4. “Cyber-bullying” or any bullying done through
the use of technology or any electronic
means.
• 2. “Gender-based bullying” refersto any
act that humiliates or excludes a person on
the basis of perceived or actual sexual
orientation

• 1. “Social Bullying” – refers to any


deliberate, repetitive and aggressive social
behavior intended to hurt others
• “Bully” – refers to any student who
commits acts of bullying
• “Bullied” or “Victim” – refers to any
student who experiences the acts of
bullying or retaliation
• “Bystander” – refers to any person who
witnesses or has personal knowledge of
any actual or perceived acts of
incidents of bullying or retaliation
• “Learning centers – refers to learning
resources and facilities of a learning
program for out-of-school youth and
adults
• “Service Provider” – refers to any person
who is not a teacher or school personnel
but who works in the school.
Section 5. Prohibited Acts
1. Bullying at the following:
– a. school grounds
– a. property immediately adjacent to school
grounds;
– c. School-sponsored or school-related activities
– d. school bus stops
– e. School buses or other vehicles owned, leased
or used by the school
2. Bullying through the use of technology
or an electronic device
3. Bullying at a location, activity, function
or program that is not school-related
4. Retaliation against a person who
reports bullying, who provides
information during an investigation of
bullying
Section 6. Prevention Programs
• (1) School-wide initiatives centered on:
–A. positive school climate and
environment
–B. periodic assessment and monitoring
of the nature, extent, and perceptions
of bullying behaviors and attitudes of
students
• C. periodic review and enhancement of
the students and personnel’s manual or
code of conduct in relation to bullying;
• D. conduct of activities for students,
school personnel and service providers on
how to recognize and respond to bullying
• E. continuing personnel development to
sustain bullying prevention programs
• F. coordination with LGU, barangay(Brgy
Council for the Protection of Children) and
other stakeholders

• (2) Classroom-level initiatives that focus


on:
• A. reinforcing school-wide rules pertaining
to bullying
• B. building a positive sense of self and
interpersonal relationship
• c. discussion of issues related to
bullying, and strategies for
responsing to and reporting of
incidents of bullying;
• D. Teaching positive online behavior
and safety and how to recognize and
report cyber-bullying; and
• E. providing an inclusive and caring
learning environment for students.
• (3) Involving parents in bullying prevention
activities, such as;
– A. discussion of the anti-bullying policy of the
school
– B. Conducting or sponsoring education sessions
for parents to learn, teach, model and reinforce
positive social and emotional skills to their
children.
(4) Monitoring students
- who are vulnerable to committing aggressive acts
or who are perpetrators of bullying
- or who are possible targets or victims
Section 7. Intervention Programs
 Interventions may include programs such
as counseling, life skills training,
education, and other activities.
 All schools shall develop intervention
strategies involving all parties, such as
bullies, victims, bystanders, parents,
school personnel, service providers and
all other persons who may be affected by
the bullying incident.
MECHANISMS AND PROCEDURES
IN HANDLING BULLYING
INCIDENTS IN SCHOOLS
• Section 8.4 Duties and Responsibilities –
Schools
• A. Adopt and implement a child protection or
anti-bullying policy in accordance with this
IRR and submit the same to the Division
Office. The anti-bullying policy may be a part
of the school’s child protection policy.

Section 10. Procedures in Handling
SchoolsBullying Incidents in
• A. Jurisdiction.
 within the exclusive jurisdiction of the
Department or the private school
B.Immediate Response
i. Stopping the bullying or retaliation
immediately;
ii. Separating the students involved;
iii. Removing the victim or, the bully or offending
student from the site;
• Iv. Ensuring the victim’s safety, by:
• Determining and addressing the victims safety
• Ensuring medical attention, if needed, and securing
a medical certificate, in cases of physical injury.
v.Bringing the bully to the Guidance Office or the
designated school personnel.
b.Reporting the Bullying Incident or Retaliation
- bullying or retaliation involves students from
more than one school
- Reports of bullying or retaliation who prefer
anonymity
c. Fact – Finding and Documentation
• School Administrator/principal/school
head/guidance counselor/teacher/school
personnel shall;
1. Interview separately
2. Determine the levels of threats and
develop intervention strategies.
-level of threat is high, appropriate action
shall be taken by the school w/in 24 hours

from the time of the incident.


3. Inform the victim and the parents or guardian
of the steps to be taken
4. Make the appropriate recommendation to
the Child Protection Committee on proper
intervention, referrals and monitoring.

believes that appropriate criminal charges
may be pursued against the bully or offending

F. Disciplinary Measures
 Written reprimand, community service,
suspension, exclusion or expulsion, in
accordance with existing rules and
regulations of the school or of the
Department for public schools, may be
imposed, if the circumstances warrant the
imposition of such penalty, provided that the
requirements of due process are complied
with.
 Bully (required) and parents are encouraged
• To join the intervention program.

• G. Due Process
In all cases where penalty is imposed; minimum
requirements of due process shall be complied
with;
a. inform the student and parents/guardian of
the complaint in writing;
b. Student shall be given opportunity to answer
with the assistance or p/g.

“Anti – Photo and Video Voyeurism


Act of 2009”
Sec. 2. Declaration of Policy. – The State
values the dignity and privacy of every
human person and guarantee full
respect for human rights.
• The State
shall penalize acts that would destroy
the honor, dignity and integrity of a
person.
(a)“Broadcast” means to make public, by
means, a visual image with the intent
that it be viewed by a person or
persons.
(b)“Capture” with respect to an image,
means to videotape, photograph, film,
record by any means, or broadcast.
(c) “Female breast” means any portion
of the female breast.
(d) “Photo or video voyeurism” means
the act of taking photo or video
coverage of a person or group of
persons performing sexual act or any
similar activity or of capturing an
image of the private area of a person/s
without the latter’s consent, under
circumstances in which such person/s
has/have a reasonable expectation of
privacy, or the act of selling, copying,
reproducing, broadcasting, sharing,
showing or exhibiting the photo or
video coverage or recordings of such
sexual act or similar activity through
VCD/DVD, internet, cellular phones
and similar means or device without
the written consent of the person/s
involved, notwithstanding that consent
to record or take photo or video
coverage of same was given by such
person’s.

(e) “Private area of a person” means the


naked or undergarment clad genitals,
public area, buttocks or female breast
of an individual.
Sec. 4. Prohibited Acts. – It is hereby
prohibited and declared unlawful for
any person:
(a) To take photo of video coverage of a
person or group of persons performing
sexual act of any similar activity or to
capture an image of the private area of
a person/s such as the naked or
undergarment clad genitals, public
area, buttocks or female breast w/o
the consent of the person/s involved
and under circumstances in which a
person/s has have a reasonable
expectation of privacy.
(b) To copy or reproduce
(c) To sell or distribute
(d) To publish or broadcast
Sec. 5. Penalties, -
• imprisonment of not less than 3 yrs
but not more 7 yrs and a fine of not
less Ph100,000.00 but not more than
P500,000.00 or both, at the discretion
of the court.
