Site selection reflects the process of building new buildings, for
company and government alike. Site selection includes considering a new
project needs against the quality of prospective sites.

UITM student at Alor Setar to give an
easier access for student and local people to

Site investigation is to examine the suitability of the site in terms of
physical properties, geological and geotechnical properties of materials
such as soils , rocks and geological structures, and the last term is building
environment.
Assessment of data collected from geological and geotechnical data that
will be used in structural design to ensure that construction is economical,
safe for living beings & ecosystem, and perform satisfactorily within the
limits and standards imposed by the authorities.

A site layout plan provides a thorough map of the whole site and the
relationship between the works being planned and the boundaries of the
land, surrounding roads and neighboring buildings.
Some applications would include an existing layout plan for sites and
a new layout plan for sites. The existing and proposed site can be
combined and displayed on one plane for simple applications so long as
what is present, what is proposed and what is to be demolished is clearly
highlighted and annotated.

ROLE OF
CONTRACTOR
Contractor who is person that undertakes a contract to provide materials or do job.

4. VARIATION
• The term “variation” means the alteration or modification of the design, quality or quantity of the
works as shown upon the Contract Drawings, Bill of Quantities, and/or Specifications, and
includes the addition, omission or substitution of any work, the alteration of the kind/standard/any
of the materials/goods to be used in the works and the removal from the site of any work,
materials/goods executed, brought thereon by the contractor for the purposes of the works other
than work, materials or goods which are not accordance with this contract.
•  The S.O. has power to order and subsequent confirmation in writing of any oral instruction
requiring a variation to the works and it will not vitiate the contract. [Clause 24.1]

5. PRIME COST AND
PROVISIONAL SUMS
• a “Prime cost” is limited to the cost of supplying the relevant item, and does not
include the cost of any work that relates to it (such as its installation).
• “Provisional sums” include allowances for both the supply item and all related work to
be performed by the contractor. 

Prime Cost: RM180 000 000.00


Provision Sums: RM 200 000 000.00
 
• For this project construction, we appoint Nominated Sub-contractor to do Mechanical
and Electrical (M&E) work. We provide prime cost amount RM180 000.00.

6. PERFORMANCE
BOND
• Paid by cash, treasury deposits, banker’s draft or insurance guarantee from approved bankers.
The sum is equal to 5% of the contract sum.
• The performance bond may be released or refunded to the contractor on the completion of
making good of all defects, shrinkages or other faults which may appear during the Defects
Liability Period and upon the giving of the Certificate of Completion of Making Good defects
for the whole of the works under Clause 45.
 
• For this project, the performance bond calculated as 5% from RM300 million project.
 
Performance bond = 5% x 300 000 000.00
= RM 15 000 000.00

7. POSSESION
OF SITE
• The possession date is the date the buyer will receive the keys to the property
and can officially move in. Often the possession is the day following
completion strictly to allow time to ensure the transaction closes.
• Completion” shall be calculated accordingly from the said “Date of
Possession”.
• In the event of delay in giving possession of site, “Date for Possession” and”
Date for Completion” shall be revised. The contractor shall not be entitled to:
• i) Claim for any loss or damaged
• ii) Determine his own employment
• Date for Possession : 18 December 2023 65
8. COMPLETION
OF WORKS
• The contractor shall complete the whole of the works on or before the
“Date of Completion” or extended as under Clause 43 (Delay and
Extension of Time).
 
• Date of Completion: 17 August 2023 

• This project took 4 years to complete. So, there have delay 15 days from
the Date of Completion due to Delay and Extension time causes by force
majeure, bad weather.

9. DAMAGE FOR
NON- COMPLETION
• 1. If the Contractor shall complete the works by "Date for
Completion" or within any extended time under Clause 43, S.O. shall
issue the "Certificate of Non-completion". Contractor shall pay
government a sum calculated at the rate stated in Appendix as
Liquidated and Ascertained Damages (LAD) for the period during
which the works remained incomplete. S.O. may deduct from any
monies which is due to Contractor. [Clause 40.2]

10. DELAY AND
EXTENSION OF TIME

• b) By reason of any exceptionally inclement weather
• c) By reason of S.O. directions, consequential upon disputes with
neighboring owners.
• d) By reason of the loss or damage due to Clause 36.

11. DEFECT
LIABILITY PERIOD
• LAD shall be defined as the penalty imposed for failure of contractor to
complete the work by the date of Completion stated in the Contract
Document or after Extension of Time (E.O.T.) is granted.11 DAMAGES

• If the contractor shall complete the works by “Date for Completion” or
within any extended time under Clause 43, S.O. shall issue “Certificate of
Non-completion”. Contractor shall pay government a sum calculated at the
rate stated in Appendix as Liquidated and Ascertained damages (LAD) for
the period during which the works remained incomplete. S.O. may deduct
from any monies due to contractor.
