Meaning and Scope of Teaching Personnel
 employed in an official capacity for the purpose of giving instructions,
whether private or public.
 formally engage in actual teaching service

• academic personnel

Recruitment, selection, promotion of teachers shall be based on merit and fitness subject
to existing criteria defined by the department of education. 
• RQA- registry of qualified applicants 
 the school superintendent shall appoint a substitute teacher from the RQA who
did not meet the cut-off score but still deemed qualified to teach.

Section 3: Recruitment and Qualification
 Recruitment policy with respect to the selection and appointment of teachers shall
clearly defined by the Department of Education:
Minimum Educational Qualifications:
• Kinder and Elementary - Bachelors Degree in Elementary Education
• Secondary- Bachelors Degree in Arts and Science (with a major and minor)
• College- Master’s Degree with a specific area of specialization

Section 3: Recruitment and Qualification
 The school superintendent may appoint , under a temporary status, applicants who do
not meet the minimum qualifications: provided further that should teacher applicants,
whether they possess the minimum educational qualifications or not, be required to
take the competitive examinations, preference in making appointments shall be in
the order of their respective ranks in said competitive examinations: and provided
finally, that the result of the examination shall be made public and every applicant
shall be furnished with his score and rank in said examinations.

Commonwealth Act No. 177 place the public-school teachers under civil
service.

state that beginning July, 1950, new vacancies in elementary
teaching positions shall be filled by applicants who qualify in PBET
(Professional Board Examination for Teachers)
Based on Civil Service Rules and Regulations, public school
teachers are appointed under the following category:
1. Regular teachers
2. Temporary teachers
3. Emergency teachers
4. Substitute teachers
Teaching Personnel in Private Colleges and Universities:
a. Professor
b. Associate professor
c. Assistant professor
d. Instructor
Criteria for ranking teachers:
1. Professor
a. Training – Doctor's degree, preferred Master's degree,
minimum
b. Experience – Ten or more years' experienced related to
teaching or education; or eminence in a profession of a highly
specialized nature
c. efficiency – Evident of successful work in positions held, past
and present
d. Productive scholarship – Research and publication
e. Character and personality
2. Associate Professor
a. Training – Doctor's degree, preferred Master's degree,
minimum
b. Experience – Five to ten years' experience related to teaching
or education; or eminence in a profession of a highly specialized
nature
c. Efficiency – Evidence of successful work in positions held,
past and present
d. Productive scholarship – Research and publication
e. Character and personality
3. Assistant Professor
a. Training – Master's degree, minimum
b. Experience – three to five years' experience related to
educational work
c. Efficiency – Evidence of successful work in positions
held, past and present
d. Research and publications
e. Character and personality
4. Instructor
a. Training – Master's degree, preferred Bachelor's degree,
minimum
b. Experience – One to three years' experience related to
educational work
c. Efficiency - evidence of successful work in positions held
past and present
d. Research and publications.

Instructors are classified in two categories:
1. Full – time Instructors – teach a load of 15 hours
or more. Twenty-four teaching hours per week is the
maximum load
2. Part – time Instructors –teach a load less than 15
hours per week
Tenure of Public and Private School Teachers

Tenure – refers to the manner in, or the period for


which anything is had and enjoyed. In teaching
profession, it indicates the means whereby, or the
duration for which a teacher holds a position.
House Bill No. 8384- Expanded Magna Carta for Public School
Teachers Act.
An act strengthening and expanding the professional rights and work
incentive of public school teachers, amending for the purpose of RA No.
4670.

Section 3: No permanent teacher shall be terminated except for a just


cause or after due process. A teacher or non-teaching personnel who is
dismissed from service but later found out as an unjustly dismissed shall
be entitled to reinstate and back wages

Section 5: Tenure of Office
Stability on employment and security of tenure shall be assured the
teachers as provided under existing laws.
Subject to the provisions of Section three hereof, teachers appointed on a
provisional status for lack of necessary civil service eligibility shall be
extended permanent appointment for the position he is holding after
having rendered at least ten years of continuous, efficient and faithful
service in such position.

This bill seeks to give security of tenure to private
school teachers, the right against discrimination,
academic freedom, and benefits related to health and
study leaves. It also provides private school teachers the
right to self-organization.
Commonwealth Act No. 177 Section 4 of Article XII of the
Constitution
No officer or employee in the Civil Service shall be removed
or suspended except for cause provided by the law.
The tenure of public and private school teachers are govern
by Republic Act. No. 1792 which amended republic act no.
1161 known as Social Security Act No, 1954.
Dismissal for Cause
• Immoral conduct
• Incompetence
• Neglect of duty
• Substantial noncompliance with school laws
• Conviction of a crime
• Insubordination
• Fraud or misrepresentation
