BANGSAMORO ORGANIC LAW

• Bangsa means land or place while Moro means the people or the Muslims in Mindanao.

• Organic law- a law, or system of laws, that form the foundation of a government,
corporation or any other organization's body of rules.
HISTORY
AUTONOMOUS REGION IN MUSLIM
MINDANAO
• The Autonomous Region of Muslim Mindanao region was first created on August 1, 1989
through Republic Act No. 6734 (otherwise known as the Organic Act)

• Muslim provinces: Tawi-tawi, Sulu, Basilan, Lanao del Sur, and Maguindanao.


WHAT IS THE COMPREHENSIVE
AGREEMENT ON THE BANGSAMORO ?
• The CAB which was signed on 27 March 2014 culminates the 17 years of negotiations
between the Government of the Philippines (GPH) and the Moro Islamic Liberation Front
(MILF) and proposes a comprehensive political settlement that aims to provide a just and
lasting solution to the armed conflict.
BANGSAMORO BASIC LAW

• The Bangsamoro Basic Law was crafted by the Bangamoro Transition Commission (BTC) in
accordance with the Comprehensive Agreement on the Bangsamoro (CAB) signed by and
between the Government of the Republic of the Philippines (GPH) and the Moro Islamic
Liberation Front (MILF) on 27 March 2014. It was a product of 17-years of tortuous
negotiations between the two parties, and has undergone a series of consultations among
parties in conflict.
BANGSAMORO PEACE PROCESS

• During his inaugural speech on 30 June 2016, Pres. Duterte committed to implement all signed
agreements in step with constitutional and legal reforms. This includes the implementation of
the Comprehensive Agreement on the Bangsamoro (CAB).

the ARMM,” as amended by RA 9054, entitled “An Act to strengthen and expand the Organic Act
for the ARMM”
WHY PURSUE THE PEACE PROCESS?

We are instituting peace and stabiliity in Muslim Mindanao not through violence (all-out-war)
but through a negotiated political settlement to address:

• Historical injustices committed against Bangsamoro

• Minoritization and landlessness

• Relative economic deprivation and underdevelopment

• Political and cultural marginalization

• The just aspirations of the Bangsamoro people for self-determination while preserving and
strengthening the territorial integrity of the Republic of the Philippines.

b) PROVIDE FOR ITS BASIC STRUCTURE OF GOVERNMENT
c) ALLOWING FOR MEANINGFUL SELF-GOVERNANCE
WHAT IS BANGSAMORO?

The Bangsamoro is the secular autonomous government


mandated in the Constitution.
The Bangsamoro is not an Islamic state.
BANGSAMORO IDENTITY
Bangsamoro people refers to those who, at the advent of the
Spanish colonization, were considered natives or original
inhabitants of Mindanao and the Sulu archipelago and its
adjacent islands, whether of mixed or full-blood, shall have
the right to identify themselves, their spouses and
descendants, as Bangsamoro.

The Bangsamoro Government shall recognize and promote the rights of non-
Moro indigenous peoples in the Bangsamoro

INCLUSIVITY IN THE BANGSAMORO
ORGANIC LAW
• Ten percent (10%) of the seats in the Bangsamoro Parliament reserved for non-Moro indigenous
peoples and settler communities, women, youth, traditional leaders, and the ulama
• Promotion of rights of non-Moro IPs in the Bangsamoro through the creation of a Ministry for
Indigenous Peoples that will formulate and implement policies, plans, and programs for all IPs in the
region, on top of upholding the existing laws for Ips
• Representation of traditional leaders, non-Moro indigenous communities, women, settler
communities, the Ulama, youth, and Bangsamoro communities outside of the Bangsamoro
Autonomous Region in the Council of Leaders that shall advice the Chief Minister in governace
• Respect of existing customary justice system of the Bangsamoro people and allows its practice in
harmony with the Constitution, such as the Shari’ah, traditional or tribal laws, and other relevant laws
• Participation of women in the Bangsamoro Cabinet
• Mechanisms for consultations for women and marginalized sectors

All powers, functions and responsibilities not granted by the


Constitution or by national law to the Bangsamoro
Government shall be vested in the National Government (see
Art. V, Sec.1)

Powers of the Bangsamoro Government
shall be vested in the Parliament who
shall set policies, legislate on matters
within its authority, and elect a Chief
Misniter who shall exercise executive
authority on its behalf.

There shall be two (2) Deputy Chief


Minister who shall be nominated by the
Chief Minister and elected by
members of the Parliament.

Qualification: At least Twenty five (25) years old on the day of the election, able to read and write
and a registered voter of the Bangsamoro.
*Youth representatives should be at least 18 years old and not more than 30 years old on the day of
the election,.
TERM OF OFFICE OF ALL PARLIAMENT MEMBERS: Three Years.
*No member shall serve for more than three (3) consecutive terms.
THE PRESIDENT OF THE PHILIPPINES SHALL EXERCISE GENERAL
SUPERVISION OVER THE BANGSAMORO GOVERNMENT TO ENSURE THAT
LAWS ARE FAITHFULLY EXECUTED.
