DILG ISSUANCES

Sections 11 and 12 of R.A.9003 enjoined the


creation of Provincial, City, and Municipal Solid
Waste Management Board. Further, a Barangay
Solid Waste Management Committee is created
in consonance to Section 10 of R.A. 9003
through the issuance of DILG MC No. 2001-38.
DILG MC. NO. 2001-38 emphasizes the vital role of
the barangay in the successful implementation of
the program, practically in the segregation,
collection and recycling of waste at source.

Barangay Ecological Solid Waste Management
Committee (BESWMC)

*Religious organizations representative
*President or Representative from the Association of Business Community

*President of the Market Vendors Association and Junkyard owners, if any
Functions of the BESWMC
• Formulate a community solid waste management program consistent with that of
the municipality;
• Be responsible for the segregation and collection of solid waste specifically for
biodgradable, compostable and reusable wastes;
• Establish within the barangay or cluster of barangays a Materials Recovery Facility
(MRF);
• Allocate funds for the barangay ecological solid waste management program,
approved by the Sangguniang Barangay. The BESWM Committee should organize a
Core of Area/Street Coordinators through the conduct of trainings for barangay
residents on segregation, composting, recycling and livelihood opportunities from
use of recyclable waste and monitor their implementation;
• Integrate the Ecological Solid Waste Management Program in the Barangay
Development Plan and/or Annual Investment Program;
• Find alternative sources of funds other than the regular barangay budgets; and
• Submit a monthly report to the municipal ESWMBoard on the progress of the
program, copy furnished the local DILG Office.

Sanctions
• Local government officials and officials of
government agencies concerned who fail to
comply with and enforce rules and
regulations promulgated relative to this Act
shall be charged administratively in
accordance with R.A. 7160 and other
existing laws, rules and regulations.
EXECUTIVE FUNCTIONS OF THE PUNONG BARANGAY
(LGC Sec 389)
(Selected functions related to solid waste management only)

• (a) Enforce all laws and ordinances which are applicable within
the Barangay;
• (i) Enforce laws and regulations relating to pollution control and
protection of the environment;
• (l) Ensure the delivery of basic services as mandated under
Section 17 of this Code;
• (n) Promote the general welfare of the Barangay; and
• (o) Exercise such other powers and perform such other duties
and functions as may be prescribed by law or ordinance.
Grounds for Disciplinary Actions (Sec. 60, LGC)
Like any elective officials, barangay officials face certain
sanctions if they do not fulfill their duties or use their powers
properly.
Barangay officials may be disciplined, suspended, or removed from
office on any of the following grounds: (selected grounds related to solid
waste management only)
c) Dishonesty, oppression, misconduct in office, GROSS
NEGLIGENCE, OR DERELICTION OF DUTY;
e) Abuse of authority
h) Such other grounds as may be provided in the Code and other
laws.
