Government Regulation
of e-commerce
CONTEXT

E-commerce as a promising and emerging practice of economic growth continues to attract


businesses, governments and consumers. But it is clear that any activity, especially one involving
several actors, must be regulated by legal texts specifying the rights and obligations of each of
the parties involved. Hence the need to put in place a legal device likely to govern the commercial
operations related to this particular mode of trade. A need that is even stronger given the virtual
aspect of electronic commerce and its particularities as a new practice not planned in the legal
field until 2007.

New laws were adopted in Morocco in the past decade to create a legislative environment
conducive to the evolution of digital commerce and ensure a climate of digital trust between the
various stakeholders.
GENERAL REGULATORY ENVIRONMENT

The development of Moroccan laws relating to electronic commerce is based on the following
international references:

- the UNCITRAL Model Laws (the United Nations Commission on International Trade Law) on
e-commerce and the electronic signature.

- European Directive n ° 1999/93 EC of the European Parliament concerning


a community framework for electronic signatures and e-commerce.
MAIN LAWS OF E-COMMERCE IN MOROCCO

Law No. 53-05 on the Electronic Exchange of Legal Data:

One month after the authorization of Internet payment in Morocco in October 2007, the Dahir No. 1-07-129 was adopted
promulgating Law No. 53-05 on the electronic exchange of legal data. The main contributions of this law are:

- Equivalence between paper and electronic documents.

- Legal definition of the electronic signature and its equivalence with the handwritten signature.

- Legal framework applicable to the operations performed by the providers of electronic certification services and the rules
to be observed.

Law 09-08 on the protection of personal data:

Also, in the context of strengthening the legal framework relating to electronic commerce, and in order to comply with
international standards in the field of digital trust, Morocco has recently adopted law 09-08 relating to the protection of
individuals against the mishandling of their personal data. The golden rule in this law is the need for prior consent. In other
words, the processing of personal data can only be carried out if the person concerned has given his or her formal
consent.
