 Elements of the Crime
1. That the offender has authority, influence or moral
ascendancy over the victim

2. The authority, influence or moral ascendancy exists in a

work, training or education environment

3. The offender demands, requests or otherwise requires any

sexual favor from the victim

4. The sexual favor is made as a condition in the employment

or continued employment of the victim; or that refusal to
grant the sexual favor results in her discrimination or
impairment of her rights and privileges; or the demand for
sexual favor would result in an intimidating, hostile or
offensive environment for the employee

• Imprisonment of 1 month to 6 months or a
fine between P10,000 to P20,000

• 3 years
