INTRODUCTION

• MAQASID SHARIAH MEANING

Maqasid shariah is the foundation for the shariah rules and


regulations.Maqasid shariah provides the knowledge, understanding and
justification for the principles of shariah.

The aims of maqasid shariah is to benefit and protect the Ummah


generally, and to discipline and structure the living in accordance with the
Islamic values and principles as pronounced in the Quran and Sunnah.

Shariah is understood in the broader meaning andscope instead of


reducing it into the domain of ‘Islamic law’ or ‘Islamicrulings’ (ahkam)
pertaining to ‘ibadah (that regulates God and Manrelationship) or
mu’amalah (that regulates man to man relationship).

THREE OBJECTIVES OF STUDY

 Identify definition and Maqasid al-Shari’ah in general

 Identify the significant of maqasid in Ijtihad

 Identify the classification and the hierarchy of maqasid al-shari’ah

PROBLEM STATEMENT

 Maqasid al-Shari’ah is the aims or goals intended by Islamic law for the
realization of benefit to mankind.

 The primary objective of Islamic law is the realization of benefit to


mankind, concerning their affairs both in this world and the hereafter.

 Thus the main objective of Islamic law is to bring benefits to mankind


and to prevent them from harm (jalb manfa’ah wa dar’ al-mafsadah).
The significant of maqasid in Ijtihad. Knowledge on maqasid is
necessary in ijtihad

SIGNIFICANT OF STUDY

 All of these three categories of maqasid, the essential maqasid have


priority over complementary maqasid which in turn have priority over
the embellishment. And among the five essential values, the
preservation and protection of religion has preference over the
preservation and protection of life: life has higher priority than lineage;
lineage is prior to intellect and intellect is preferred over property

FINDING OF MAQASID SHARIAH

Al-Imam as-Syatibi, the First Master[1] of this field in his book al-Muwafaqat fi
Usul as-Syari’ah had include a chapter on Maqasid al-Syari’ah, as well as placing it
in a systematic way by including comprehensive and lengthy discussions on it.

In his book entitled Ghiyats al-Umam fi al-Tayyats al-Zhulam ‫ياث‬


( EEE‫ ت‬E‫ي‬EE‫ ف‬E‫م‬E‫ألم‬EE‫غياث ا‬
E‫ظلم‬EE‫) لا‬, he expressed his worry and concern on the issue of the fall of ethics in a
Muslim community, especially in the aspect of Islamic scholars, intellectualism and
politics.

The only way to be free from this problem is none other than by establishing
Maqasid al-Syari’ah which is universal and uplift it from zhanniy

And whoever does not understand the existence of maqasid in the Shari’ah
commands and prohibitions, then he does not acquire the clear and true prospect of
Shari’ah”

DISCUSSION OF MAQASID
SHARIAH

 The Universal Declaration of Human Rights (UDHR) is the most common


document referred to in the area of human rights law.

 The main objective absolutely is to protect the human rights of people from all
over the world

 Human Rights consists of the Universal Declaration of Human Rights, the


International Covenant on Economic, Social and Cultural Rights, and the
International Covenant on Civil and Political Rights and its two Optional Protocols.

 Aims at identifying respective country‟s common strengths and opportunities,


which hopefully will lead to improving the quality of life for all people.

CONCLUSION

 the maqasid have become the focus of attention as it tends to provide


ready and convenient access to the Shari’ah.
 it is naturally meaningful to understand the broad outline of the
objectives of the Shari’ah in the first place before one tries to move on
to specifics. An adequate knowledge of the maqasid
 thus equips the student of Shari’ah with insight and provides him with a
theoretical framework in which the attempt to
 acquire detailed knowledge of its various doctrines can be more
meaningful and interesting
