• 3. ACTUALLY OCCUPIED AND UTILIZED FOR
PUBLIC USE OR PUBLIC PURPOSE.

Note: Issuance of Special Patent under item # 3 is vested with


the PENRO. (DAO #2016-21)
PROCLAMATIONS

“Acts of the President fixing a date or declaring a


status or condition of public moment or interest,
upon the existence of which the operation of a
specific law or regulation is made to depend, shall
be promulgated in proclamations which shall have
the force of an executive order.”

– Administrative Code of 1987,


Book III, Chapter 2, Section 4
Reservation for Public or Semi-Public
Purposes (cont.)
Also included under the aforesaid Section is the reservations
for the following:
  a)     Highways;
b)     Right of way for railroads;
c)     Hydraulic Power Sites;
d)     Irrigation systems;
e) Communal Pastures or Leguas Communales;
f)      Public Parks;
g)     Public Quarries;
h)      Public Fishponds;
i)        Working Men’s Village; and
j)       Other improvements for public benefit.
Purposes for
the Issuance
Special Patents shall only be issued for the
following purposes:

a. Charitable or other similar


purposes run
administered by thegovernment or or any
branches or instrumentalities; of its
b. public cemetery, municipal halls, public plazas or
parks and other government institutions for public
use or public purpose;
c. Other similar public purposes that may be
identified. (DAO #2016-21 series of 2016)
