Fact:

On 4 November 1979 there was an
armed attack by Iranian students on
the United States Embassy in
Tehran and they overtook it. The
students, belonging to the Muslim
Student Followers of the Imam's Line,
did this as an act of support to
the Iranian Revolution.

Issues:
The United States attributes the
worsening of relations to the 1979–
81 Iran hostage crisis, Iran's repeated
human rights abuses since the
Islamic Revolution, and its growing
influence in the Middle East. Since
1995, the United States has had an
embargo on trade with Iran.
Principles:
Diplomatic immunity is a special immunity for foreign states or
international organisations and their official
representatives like consular staff in this case from the
jurisdiction of the country in which they (foreigners ) are
present. Treaty law In this case, Iran government had
violating treaty relationship owed by it to the United States
under convensions in force between the two countries. But
Iran should obey treaty obligations. State responsibility
State responsibility is one of the fundamental principle of
general international law. So, Iran government must be
liable for violating state responsibility. Hostages rights in
international law Taking hostages are a wrongful act that
are strongly prohibited by international conventions
according to international human rights law. So, Iran
government was bound to doing this kind of act against its
Diplomatic and consular staff.
Judgment:

 First decision issued in December


15, 1979.
 Second decision addressed the
actual merits of Iran’s action.
 The court reached a judgment on 24
may, 1980.
Explanation and reasoning behind
judgement:

• No more fundamental prerequisites


for relations between states than
embasis.
• Iran violated the obligations owned
by USA.
• Court reaffirmed the cardinal
importance of the principles of
International Law governing
diplomatic and consul or relations.
Opinions and conclusion:
 It’s very clear and obvious that the government of
Iran has violated several aspects of international
law.
 The ICJ has decided that the Iranian government
must immediately take all the necessary steps to
redress this problematic situation.
 Conclusion As the Iranian government has violated
the rules and regulations of International Law they
must release the United States nationals.
