One’s personal interest comes into
conflict with his/her duty to act in the
interest of others (biased judgments)

position to derive personal benefit from
actions or decisions made in his/her
official capacity (misuse of position)
Types of Conflict of Interest
 Actual : discharging one’s duties to employer
or others in a way that is prejudicial to their
interest
 Potential: Possibility of conflict of interest
 Apparent :A judge cannot preside over a case
of his family
 Others-Impersonal: A lawyer cannot
represent two clients with conflicting interests
Whistle-Blowing
Comes from sports: referee blows whistle
to stop play when there is foul or
improper conduct
Employment : attempt by member or
former member of an organisation to
disclose wrongdoing in or by an
organisation
Types of Whistle-blowing
 Governmental : initiated in the government
sector
 Internal: disclosures made by employees to
executives in a firm concerning improper
conduct
 Personal
: a person complains of sexual
harassment
 External : happens when ‘internal’ fails
Consequences
 (NOTE : Whistle-blowing should be
undertaken as a moral protest, that is, the
motive must be to correct some wrong, and
NOT seek revenge or personal advancement)

Is It Morally Justified?

Morally prohibited – principle of loyalty


 Morally justified – the right of free
speech and to know the truth; if there
are serious consequences where harm is
involved
 Internal remedies have been attempted
in good faith
