RULE 1020

REGISTRATION
General Provisions
• Every employer as defined in Rule 1002 (1)
shall register his business with the Regional
Labor Office or authorized representative
having jurisdiction thereof to form part of a
databank of all covered establishments.
Registrable Unit
• The establishment regardless of size of
economic activity, whether small, medium or
large scale in one single location, shall be one
registrable unit.
Period of Registration

•  Establishments shall register within thirty


(30) days before operation.
REQUIREMENTS
1. Application form (DOLE-BWC-IP-3 );
2. Business Permit;
3.  SEC Certificate or DTI Registration.
4.  Registration shall include a layout plan of
the place of work.
• Registration shall be free of charge and valid for the
lifetime of the establishment except when any of the
following conditions exists, in which case, re-
registration as if it were a new establishment is
required:
a. change in business name,
b. change in location,
c. change in ownership, or
d. re-opening after previous closing.

FOREIGN NATIONALS)
WHAT IS AN ALIEN EMPLOYMENT PERMIT (AEP)?
• An Alien Employment Permit is a document
issued by the Department of Labor and
Employment which authorizes a foreign national
to work in the Philippines.
• All foreign nationals who intend to engage in
gainful in the Philippines shall apply for and
AEP.
• Gainful employment shall refer to a state or
condition that creates an employer-employee
relationship between the Philippine-based
Employer and the foreign national.
SECTION 2. COVERAGE

• All foreign nationals who intend to engage in gainful employment in


the Philippines.

• Foreign professionals who are allowed to practice their profession in


the Philippines under reciprocity and other international agreements
and in consultancy services pursuant to Section 7(j) of the PRC
Modernization Act of 2000.

• Holders of Special Investors Resident Visa (SIRV), Special Retirees


Resident Visa (SRRV), Treaty Traders Visa (9d) or Special Non-Immigrant
Visa (47(a)2) for as long as they occupy any executive, advisory,
supervisory, or technical position in any establishment.
EXEMPTION
 Spouse of diplomatic corps, if there is reciprocity;
 Accredited officials and personnel (and their spouse) of international
organizations where Philippines is a member;
 Embassy personnel;
 Officers or staff of accredited or endorsed peacekeeping or international
organization;
 Teacher or researcher(reciprocity);
 DOJ recognized refugees or stateless person; and
 All other FN exempted by law.
Exclusion

 No employee-employer relationship with Philippine entity;


 Members of the board with voting rights (no management or operational
intervention);
 President and Treasurer (part owner of company);
 Intra-corporate transferee. i.e executive, manager, or specialist;
 Contractual service Supplier; and
 Accredited representative of foreign principal employers who participate in
recruitment with POEA accredited agency.
SECTION 3. REQUIREMENTS AND PROCESSING OF
APPLICATION FOR AEP
1. Application form;
2. Passport with valid visa;
3. BIR 1904 or 1902
4. Signed appointment or contract of employment;
5. CTC of valid business permit; and
6. Proof of publication of job vacancy in newspaper.
7. Other required permits from PRC ,DOJ,DENR, as
necessary.
8. If renewal of expired AEP, present the expired AEP
Card
SECTION 4.FEES
 10,000Php for New AEP Application (1 year validity) inclusive of
4,000php for publication fee;
 Additional 5,000php for every additional year;
 For renewal, 5,000Php per year;
 For card replacement, 3,000Php; and
 For certification of exemption or exclusion, 2,000php per issuance.
SECTION 5. LABOR MARKET TEST
• Publication by the employer 15 days prior to the application for AEP
• Publication by DOLE-RO within 2 days upon receipt of the application
• Publication shall contain the
i. Name;
ii. position, description, qualification;
iii. salary range and other benefits;
iv. Employers name and address
v. Notice that any person in the Philippines who is competent, able,
and willing to perform the services for which the foreign national
is desired, may file an objection at the DOLE RO w/in 30 days.
SECTION 23. PENALTIES
• The DOLE-RO shall impose a fine of P10,000 to
foreign nationals and P10,000 to employers for
every year or a fraction thereof for each count
of violation.
SECTION 25. DUTIES OF EMPLOYER:

 Submit quarterly report or updated list of Foreign Nationals;


 Submit report if change of employers’ information
