125 as amended by E.O. 125-A. It is embodied in Section 12 of E.O. 125 as amended by E.O. 125-A the functions of the MARINA. Some of these functions are to develop and formulate plans, policies, programs, projects, standards, promotion and development of the maritime industry, the growth and effective regulation of shipping enterprises, and for the national security objective of the country, issue certificate of Public Convenience for the operation of domestic and overseas water carriers and issue and register the continuous discharge book of Filipino seamen. The powers of the MARINA with respect to domestic shipping are now enumerated in Section 10 of RA 9295 which was passed in May 2004. The powers and authority of MARINA are: Register vessels; Issue certificates of public convenience or any extensions or amendments thereto, authorizing the operation of all kinds. Classes and types of vessels in domestic shipping: Provided, That no such certificate shall be valid for a period of more than twenty-five (25) years; Determine the impact which any new service shall have to the locality it will serve; (11) Adopt and enforce such rules and regulations which will ensure compliance by every domestic ship operator with required safety standards and other rules and regulations on vessel safety; Issue such rules and regulations necessary to implement the provisions of this Act: Provided, That such rules and regulations cannot change or in any way amend or be contrary to the intent and purposes of this Act. Training and Certification of Seafarers
R.A. 10635 enumerates the power of the MARINA in the
implementation of and to ensure compliance with the 1978 International Convention on Standards of Training, Certification and Watch keeping for Seafarers (STCW Convention), as amended, all international agreements implementing or applying the STCW Convention, and other international maritime safety conventions or agreements that the STCW Convention seeks to promote compliance therewith. MARINA is designated as the single maritime administration mandated to implement and enforce the STCW Convention. Philippine Coast Guard (PCG) The present governing law is R.A. 9993 otherwise known as the Philippine Coast Guard Law of 2009. it is described in the law as an armed and uninformed service attached to the Department of Transportation and Communications. However, in times of war, the PCG is attached to the Department of National Defense. P.D. 857 issued in December 1975 organized the Philippine Ports Philippine Authority. The law recognized the Ports need to integrate and coordinate port planning, development, Authority control and operations at the national level, and at the same time promote growth of regional port bodies responsive to the needs of their individual localities.
