ECC/ EIS CLAUSES ON ASBESTOS MANAGEMENT
1. ECC No. 9812-002-301 for the Company’s Nonoc Nickel Project,
General Condition #12 provides, “The Environmental Management and
Monitoring Plan shall be implemented by the proponent and its
contractors/subcontractors through the life of the project”.

2. EIS for the Nonoc Nickel Project, Volume 1, Section 5.0 provides,
“Based on the established existing environmental conditions in the
project area, the assessment and the prediction of the impacts can be
made using models. This section (of the EIS) identified these impacts
and recommends the mitigating measures to address the negative
impacts and actions to sustain positive impacts.”

3. EIS, Vol. 1, Section 5.1.4.1.1 provides, “Asbestos is a mineral


widely used previously due to its uses and qualities. It is strong,
flexible, corrosion proof, conducts electricity poorly but insulates
effectively. Most of the asbestos containing materials (ACM) still
present on site belong to United States Environmental Protection
Agency (USEPA) Category II non-friable ACM. According to USEPA,
Category II non-friable ACM is any material containing more than one
(1%) asbestos as determined using polarized light microscopy that
when dry cannot be crumbled, pulverized, or reduced to powder by
hand pressure”.

4. EIS, Vol. 1, Subsection 5.1.4.2.1 General Measures


provides, “An environmental management system
(EMS) shall be put in place not only to ensure a
working system for solid waste management but also
enable Philnico (PNPI) to manage its environmental
aspects efficiently.

Adequate disposal facilities (including construction


of sanitary and secured landfill per Matrix 7.1 of the
Environmental Management Plan under Section 7.0 of
EIS, Vol. 1 for the Nonoc Nickel Project), specifically
for solid wastes, shall be developed to ensure proper
disposal of generated wastes.

SPECIAL CONCERNS AND REQUEST
 To date, an inventory of 544 tons Asbestos Containing Material (ACM), as reported
in the Quarterly Self-Monitoring Report (SMR) being submitted to EMB, is still
present on site mainly in residential housing units and some buildings. Most of the
asbestos roofing sheets are still in good condition and do not release asbestos fiber.

 Based on the project’s approved Environmental Impact Statement (EIS) Report, the
ACM onsite is characterized as Category-II non-friable ACM by the United States
Environmental Protection Agency (USEPA).

 The approved ECC and corresponding EIS report of Pacific Nickel Philippines, Inc.
(PNPI) cover provision for the construction and operation of a secured landfill
where the ACM can be accommodated and disposed properly.

 Relative to the said concern, PNPI would like to request for your expert technical
and regulatory guidance on how we can best address and/or be issued with Permit
and/or Notice to Proceed on Managing the Asbestos Containing Materials (ACM)
at the Site; to commence with Phase 1 Removal of 18-ton ACM Roofing Sheets of
Admin Building, as presented, and in accordance to applicable environmental laws,
rules and regulations.
