BACKGROUND
 Rights are not normative inherent in humans since humans are still in stock until the end of
their death. No one here opposes the friction between individuals in the effort to fulfill human
rights on their own. This can then lead to human rights battles against other individuals,
groups against individuals, or vice versa.
 After the 1998 reforms, Indonesia increased its success in the field of human rights
enforcement for the entire population. Human rights instruments were established as an effort
to support a more optimal commitment to upholding human rights. However, along with this
progress, stalled human rights also often occur around us. To help us compile a paper entitled
"Examples of Cases of Human Rights Violations in Indonesia", to provide information about
what human rights are needed
THEORETICAL BASIS
 THEORETICAL BASIS
 Theoretically Human Rights are rights inherent in human beings that are natural and
fundamental as a gift of God that must be respected, safeguarded, and protected. While the
nature of Human Rights itself is an effort to maintain the safety of human existence as a whole
through a balanced action between individual interests and the public interest. Likewise,
efforts to respect, protect, and uphold Human Rights become joint obligations and
responsibilities between individuals, the government (both Civil and Military Government
Apparatus), and the state.
DEFINITION OF VIOLATIONS OF HUMAN
RIGHTS

 According to Article 1 Number 6 No. 39 of 1999 what is meant by human rights violations is
every act of a person or group of people including state officials, whether intentional or
unintentional or negligence that legally reduces, impedes, limits and or revokes the human
rights of a person or group of people guaranteed by law legislation and not getting or feared
will not get a legal remorse that is fair and true based on applicable legal mechanisms.
 According to Law No. 26 of 2000 concerning human rights courts, human rights violations are
any acts of a person or group including state officials either intentional or negligence that
legally reduces, obstructs, limits and or revokes the human rights of a person or group of
people guaranteed by law. This law, and is not obtained, or is feared, will not obtain a fair and
correct legal settlement, based on the applicable legal mechanism.
FACTORS THAT CAUSE HUMAN RIGHTS
VIOLATIONS
 Human rights violations are caused by the following factors: Internal factors, namely the
urge to commit human rights violations originating from the perpetrators of human rights
violators, including:
 Selfish attitude or too selfish; This attitude will cause a person to always claim his rights,
while his obligations are often ignored. Someone who has an attitude like this, will justify all
means so that their rights can be fulfilled, even though the method can violate the rights of
others
 Low awareness of human rights: This will cause the perpetrators of human rights violations
to do whatever they want. Perpetrators do not want to know that other people also have rights
that must be respected. This attitude of not wanting to know results in behavior or deviation
from human rights
 Intolerant attitude :This attitude will lead to the emergence of mutual disrespect and
disrespect for the position or existence of others. This attitude will ultimately encourage
people to discriminate against others.
EXTERNAL FACTORS
 namely factors outside of human beings that encourage a person or group of people to violate
human rights, including the following:
 Abuse of power :In society there are many powers that apply. Power here not only refers to
governmental power, but also other forms of power found in society.
 The indecisiveness of law enforcement officers, :Law enforcement officials who do not act
decisively against any violation of human rights, of course, will encourage other human rights
violations.
 Misuse of technology :Technological progress can have a positive influence, but it can also
have a negative influence and can even lead to crime.
 High social and economic inequality :The gap illustrates the occurrence of a striking
imbalance in people's lives.

VIOLATIONS
 The Trisakti and Cloverleaf Cases
 The Trisakti and Semanggi human rights violations are closely related to the reform movement
in 1998. Triggered by the economic crisis in 1997 and the actions of the Community Service
during President Soeharto's presidency, a massive reform movement was pioneered by
students. The students also held a demonstration which ended in a physical clash with the
authorities. This finally led to the deaths of 4 students from Trisakti University due to the
bullet fire. While the Semanggi tragedy occurred 6 months later on November 13, 1998, which
killed 5 students. These two events triggered riots throughout Indonesia. Riots and violence
ensued everywhere and killed thousands of residents. The May 1998 riots were also recorded
as one of the dark years of Indonesian history.
 The case of Marsinah
 Marsinah human rights violations occurred on May 3 and 4, 1993. This case began with
demonstrations and strikes by PT.CPS workers. Marsinah and 12 other workers demanded that
the company revoke their layoff status. But five days later, Marsinah was found dead in the
forest of Wilangan, Nganjuk city in a pathetic condition.
 Bali Bombing Case
 The Bali Bombing Case is also one of the biggest human rights violation cases in Indonesia.
This incident occurred on November 12, 2002, where a bombing by a terrorist group occurred
in the Legian area of ​Kuta, Bali. In total there were 202 people who died, both from local
residents and foreign tourists who were on vacation. As a result of this event, there was panic
throughout Indonesia over the dangers of terrorists that continued into the following years.
 The Munir Murder Case
 The Munir murder case is one of the human rights violations in Indonesia where the case has
not been resolved until finally closed. Munir Said Thalib is not just anyone, he is a human
rights activist who has handled cases of human rights violations. He died on September 7,
2004 on a Garuda Indonesia flight en route to the city of Amsterdam in the Netherlands. Many
people think that Munir died because he was killed or poisoned by a certain group.
Unfortunately until now the case of Munir's death is unclear and the case itself has finally been
closed.
 Tanjung Priok incident
 Another human rights violation case in Indonesia has occurred in the Tanjung Priok area,
North Jakarta. This case is purely a violation of human rights. It began when residents around
Tanjung Priok, North Jakarta held a demonstration along with the riots because of the effort to
remove the sacred tomb of Mbah Priok for other purposes. This then led to clashes between
residents and the police and members of the TNI which resulted in some residents being killed
and injured
CONCLUSION
 Human rights are basic rights possessed by humans in accordance with their work. Every
individual has a desire that his human rights are fulfilled, but one thing we need to remember
that Never violate or oppress other people's human rights. In the life of a human rights state, it
is regulated and protected by Indonesian law, where every form of human rights violation
committed by a person, group or an institution or even a State will be tried in the
implementation of human rights justice, the human rights court takes the court process through
the human rights court procedural law as contained in the Human Rights court Act.
