Policies Affecting Hospitals


Republic Act
An act passed by the Congress of the Philippines, while the form
of government is Republican Government
Republic Act
• RA No. 349 – (Approved: May 17, 1949) Legalizes the use of human
organs for surgical, medical and scientific purposes
• RA No. 1054 – (June 12, 1954) Requires owners/lessee/operator of any
commercial, industrial or agricultural establishment to furnish free
emergency, medical and dental assistance to his employees and laborers.
• RA No. 1612 – (August 24, 1956) Payment of Privilege taxes; must be
paid before any business or occupation can be lawfully begun or pursued.
Republic Act
• RA No. 4226 – (June 19, 1965) Hospital Licensure Act; requires all hospitals
to be licensed before it can operate
• The Bureau of Medical Services – licensing agency, set standards in hospital construction
and operation; the Powers and duties include:

• conduct an ocular survey • make periodic inspection of all hospitals


• prescribe standard plans for government • publish yearly a list of all approved
hospital plants hospitals
• approve plans for hospital plants and • submit yearly reports to the Secretary of

• RA No. 6727 – (June 9, 1989) Wage Rationalization Act; rationalize fixing of
minimum wages

Republic Act
• RA No. 6758 – (August 21, 1989) Compensation and Position Classification
Act of 1989; Department of Budget and Managements (DBM) is directed to
establish and administer a unified Compensation and Position Classification
System
• All allowances shall be deemed included in the standardized salary rates herein
prescribed
• RA No. 7164 – (November 21, 1991) Philippine Nursing Act of 1991
• RA No. 7170 – (January 7, 1992) Organ Donation Act of 1991

• RA No. 7875 – (July 25, 1994) National Health Insurance Act of 1995
• This Act seeks to provide all citizens of the Philippines with the mechanism to gain
financial access to health services
• To serve as the means to help the people pay for health care services
• Prioritize and accelerate the provision of health services to all Filipinos
• Establish the PHIC
Republic Act
• RA No. 8344 – (August 25,1997) An Act penalizing the refusal of hospitals
and medical clinics to administer appropriate initial medical treatment and
support in emergency or serious cases
• It shall be unlawful to request, solicit, demand or accept any deposit or any
other form of advance payment as a prerequisite for confinement or medical
treatment or to refuse to administer medical treatment and support as dictated
by good practice of medicine to prevent death or permanent disability
Republic Act
• RA No. 9439 – (April 27, 2007) An Act Prohibiting The Detention of Patients
in Hospitals and Medical Clinics on Grounds of Non-payment of Hospital
Bills or Medical Expenses
• Any officer/employee of the hospital or medical clinic responsible for
releasing patients who violates this act shall be punished by a fine of not less
than P20,000, but not more that P50,000, or imprisonment of not less than 1
month but not more that 6 months.
Presidential Decree
An order of the President. This power of the President which allows him/her
to act as legislators was exercised during the Martial Law
Presidential Decree
• PD No. 169 – (April 4, 1973) Requiring doctors, hospitals, clinics, etc. to
report treatment for physical injuries.
• PD No. 442 – (May 1, 1974) – Labor Code of the Philippines
• Normal hours shall not exceed 8 hours a day, five days a week
• PD No. 626 – (December 27, 1974) Employee Compensation and State
Insurance Fund.
• Provide benefits covered by SSS and GSIS for immediate injury, illness and disability
Presidential Decree
• PD No. 851 – (December 16, 1976)Requiring all employers to pay their
employees a 13th month pay
• PD No. 4226 – (June 19, 1965) Hospital Licensure Act
