CRIMES AGAINST
PERSON
 often simply referred to as violent crime, is arguably the
most serious species of crime addressed by the criminal
law
 For the purposes of criminal law, "person" refers to the
health and integrity of the body, as well as the freedom to
move about willfully. Any attempt to wrongfully harm or
wrongfully imprison another's person is considered to be
a crime of this type
Murder

 Unlawful killing of another human being with malice aforethought (evil intent)

 First degree or aggravated murder

(1) killing someone with premeditation (thinking about it or planning it);

(2) killing someone in a cruel way, such as with torture;

3) killing someone while committing a felony, such as rape, robbery, or kidnapping.


Death penalty can be used.
 Second degree

- if none of the above applies to the murder. Death penalty will not be used.
Manslaughter

 The unlawful killing of another human being without


malice aforethought.
 Voluntary manslaughter occurs when one person intends,
at the time the act is committed, to kill another but does
so suddenly and as the result of great personal distress.
 Involuntary manslaughter occurs when one person, while
committing an unlawful or reckless act, kills another.
There is no intent to kill.
Battery

 Unlawful touching of another person, most often involves


forcibly using a person’s hand, knife or gun against
another person. Battery includes giving poison or drugs to
an unsuspecting person, spitting in someone’s face,
siccing a dog on someone, and kissing someone who did
not want to be kissed.
 Simple battery is a misdemeanor. Aggravated battery is a
felony
Assault

 Attempt to commit battery. Pointing or shooting a gun at


someone is assault; the bullet striking the person is
battery.
 Simple assault is a misdemeanor refers to the intentional
violent injury toward another person Aggravated assault
is a felony. Aggravated assault and battery are
committed with a deadly weapon, or with the intent to
commit murder, rape or robbery.
Kidnapping

 Unlawful removal or restraint of a person against that


person’s will. Victim is either threatened or forced.
 Criminal act is the illegal imprisonment of another
person.
HOMICIDE

 Refers to the act of a human killing another human

 Homicides do not always involve a crime. Sometimes the law


allows homicide by allowing certain defenses to criminal
charges. One of the most recognized is self defense, which
provides that a person is entitled to commit homicide to protect
his or her own life from a deadly attack. For example, if a
police officer confronts a suspect armed with a dangerous or
deadly weapon, the officer may use force to stop the suspect. If
this force ends up killing the suspect it is still considered a
homicide, which in this case, is not illegal unde
Sex Offenses

 A person forcing another person to have sexual


intercourse, or having sexual intercourse with an under-
aged person, and other types of sexual misconduct,
including date rape.
 Statutory rape applies when victim is underage. Consent
of victim does not change the offense. In Oregon,
underage is anyone under 18. Sexual activity with anyone
under 14 carries a more severe penalty.
