ARTICLE - 90
(1) The executive authority of the Federation shall vest in the President
and shall be exercised by him, either directly or through officers
subordinate to him, in accordance with the Constitution.

ARTICLE - 99
(1) All executive actions of the Federal Government shall be expressed to be
taken in the name of the President.
(2) The President shall by rules specify the manner in which orders and other
instruments made and executed in his name shall be authenticated, and the
validity of any order or instrument so authenticated shall not be questioned
in any court on the ground that it was not made or executed by the
President.
(3) The President shall also make rules for the allocation and transaction of the
business of the Federal Government.

• “President” means the President of
Pakistan.

PROVISO
• An Additional Secretary or a Joint Secretary,
unless he is in-charge of a Ministry/Division, shall
be entrusted with a well-defined sphere of duty.
• To keep record of suspense cases and to see that such cases are
put up to Secretary on due dates.
• To prepare fair replies for the Minister and the Parliamentary Secretary
of the Ministry/Division concerned.
• Any other work which may be assigned to him in connection with the
Assembly Questions, Resolutions, Cut Motions, etc.

DISPOSAL OF BUSINESS
The following cases shall be submitted to the Secretary of a
Division:-

• This shall not apply to cases, wherein a Joint
Secretary or Additional Secretary will submit to the
Minister direct.

• If a case is received from a Division in an incomplete
form the Division to which the reference is made may
call for the information necessary to complete it.

• When a file has been referred to or returned
from another Division and a difference of opinion
between the Divisions is disclosed, personal discussion
shall as a rule., be substituted for further noting.

REFERENCE TO AND FROM AUTHORITIES OUTSIDE
THE SECRETARIAT
Notes written in one Division and sent to another shall not
be referred to any officer outside the Secretariat without the
general or special consent of the Division to which they
belong.

• A case referred to the Ministry/Division over the
signature of the head of a Department shall be placed
before the Secretary or the Joint Secretary in the case
of major Departments, or the Deputy Secretary in the
case of minor Departments.
For scrutiny and disposal of references between the Provincial and Federal
Governments, the relative status of the officers concerned as shown below:

The first reminder shall be issued after a reasonable lapse of time in the
form of an un-official note or office memorandum.
