1. TALAQ-E-SHSAN: In a single sentence
2. TALAQ-E-HASSAN: There must be 3
successive pronouncement of talaq
3. TALAQ-E-BIDDAT:TRIPLE TALAQ,(intant
talaq)
i.e. by saying “I divorce thee” thrice at the

same instant.
 ABOUT
Triple talaq ,also known as TALAQ –E-BIDDAT
Instant divorce and talaq -e-mughallazah(irrevocable
divoce),is a form of islamic divorce which has been
used by muslim in india ,especially adherents of
hanafi sunni islamic schoolsjurisprudencdunce.
It allows any muslim man to legally divorce his wife by
stating the word talaq (the arabic word for
“divoce”)three times in oral .wriiten,or more recently
electronic form.
 HISTORY
The practice faced opposition from Muslim women ,(28)some of whom
filed a public interest litigation in the supreme court against, terming it
“regressive”. The petitioners asked for section 2 of the muslim personal
law (shariat) aplication Act,1937,(A) to be scrapped ,describe it as being
against article 14 of the consitution (eqality before law ) .
On 13 may 2017, during the hearin before its final judgment ,the
supreme court describe instant triple talaq as the “worst form of
marriage dissolution”. It noted that the custom is banned in muslim-
majority countries of Saudi Arabic, morocco, Afghanistan and Pakistan.
On 8 December 2016, the Allahabad high court observed in a ruling that
the paractice of instant triple talaq was unconstitutional and violated
the right of muslim women.
 GENDER JUSTICE
• Islamic consideres marriage as a contract and it has
laid down procedures on how to annual it. A woman
can seek divorce under what is called as
“khula”,while the husband can end the marriage by
pronouncing talaq thrice, after which arbitration is
required.
• But activists have highlighted the misuse of instant
divorce by men as a reason to ban over phones have
come to light.

deemed instant triple talaq (talaq-e-biddah)
unconsitutional.three of the five judges in the
panel concurred that the practice of triple talaq is
unconsitutinal .the remaining two declared the
practice to be consitutional while simultaneously
asking the government to ban the practice by
enacting a law.
