The Kosovo Constitution – foundation of good governance.
It states that:

• Human rights and fundamental freedoms are indivisible, inalienable, and


inviolable and are the basis of the legal framework of the Republic of Kosovo.

• The Republic of Kosovo protects and guarantees human rights and fundamental
freedoms as stated in its Constitution.

• Everyone must respect the human rights and fundamental freedoms of others

• Fundamental rights and freedoms set forth in the Constitution are also valid of
legal persons to the extent applicable.

Kosovo’s Constitution

• Rule of law – when administrative actions and omissions closely follow the only Constitution and its laws

2. Responsibility – when the administration’s actions and decisions create legal certainty and eliminate arbitrary rulings.

3. Reliability and predictability – citizens have confidence in local authorities’ ability and willingness to manage, and meet their
long term needs by observing known procedures.

4. Openness – when the administration’s procedures, acts, actions and omissions are available for external monitoring and
evaluation.

5. Transparency – when local authorities adopt and implement their actions, omissions and acts in public, and publicly bear the
consequences. Each element of their activities are subject to monitoring, evaluation and control
6. Accountability – when the local administration acts with a clear division of rights and obligations, and
actions are publicized in a systematic, complete, comprehensive and fair way.

7. Effectiveness – when national, regional and local policies are developed with a thorough analysis of
immediate needs, clearly defined goals and well defined expected results.

8. Co-operation (partnership) – when acts are created and policies implement by the local administration
with full participation of citizens, social partners, civil society and the private sector.

9. Coherence – when developed policies are easily understood by citizens due to strict internal logic and
cohesion.

10. Efficiency (productivity) – when local government actions, omissions and acts result in an optimal
ratio between results and inputs.

especially concerning human rights law.

3. Transparency - every policy taken and implemented by the government must be carried
out under existing regulations.

able to produce decisions that meet every community need. Community resources must also
be utilized optimally by the government.

8. Accountability - All institutions involved in good governance have full responsibility to


the public for the sake of improving the quality of society.
