RIGHTS

Meaning
• are defined as claims of an individual that are
essential the development of his or her own self
and that are recognized by society or state.
Elements of Rights
1. Privilage - a law for just one person, a benefit enjoyed by an
individual or group beyond what is available to others..
2. Claim - are evaluative or normative. We attempt to state not
what is the case but rather, what should be the case and how the
world can be better.
3. Power - Whenever an act enhances one's strength or capacity
to rule, it is good or morally legitimate.
4. Immunities - protection or exemption from something,
especially an obligation or penalty.
Sources of Rights
Kinds of Rights
1. Natural rights - Faith in natural rights is strongly expressed byseveral
scholars. They hold that people inherit several rights from nature. Natural rights,
like the right to life, right to liberty and right to property. Natural rights are parts
are human nature and reason.

2. Moral rights- those rights which are based on human consciousness. They
are backed by moral force of human mind. These are based on human sense of
goodness and justice. These are not backed by the force of law. Sense of
goodness and public opinion are the sanctions behind moral rights.

3. Legal rights- are those rights which are recognized and enforced by the
state. Any violation of any legal right is punished by law. These right can be
enforced against individuals and also against the government.
