3.1 STATE ISLAMIC RELIGIOUS COUNCIL

 3.1.1 STATE ISLAMIC RELIGIOUS DEPARTMENT


 The state Islamic Department of Religious Affairs (MAIN / JAIN) are crucial in ensuring the
protection of halal consumerism in the Muslim community in Malaysia.
 Fatwa and guidelines are to be widely disseminated to the community and given a great deal
of understanding to entrepreneurs, traders and consumers.
 Generally, JAKIM, JAIN and MAIN, are the recognized bodies for managing halal
certification and confirms legal determination or purity of a logo and halal certificate.
3.2 DEPARTMENT OF ISLAMIC
DEVELOPMENT MALAYSIA (JAKIM)
 The department of Islamic Development Malaysia (JAKIM) is responsible for the Islamic
Affairs including Halal certification in Malaysia.
 JAKIM plays the role to protect the interest of Muslim consumers in Malaysia.
 They also responsible to remind them to seek for Halal products as required by Shariah.
 For the purpose of Halal certification, JAKIM has to ascertain the Halal status of the product
at every stage and process involved by carrying out an official site inspection on the plants to
examine how the Halal status of the raw material is maintained and monitored at all times.

 Monitoring of halal certification is conducted by JAKIM through two methods:
 i. Periodic Monitoring - conducted on JAKIM's halal certificate holders at least once a year.
 The monitoring is scheduled every month with priority monitoring of high-risk companies -
meat and poultry-based products, oils and fats, slaughterhouses, organizations / industries with
no halal control system or no halal executive and Internal Halal Committee.
 On the other hand, for low-risk companies, monitoring is only done at least once a year.
 ii. Monitoring of Public Complaints - conducted with related enforcement agencies such as
Ministry of Health, Department of Veterinary Services, Royal Malaysian Customs
Department, Local Authorities and other agencies as it thinks necessary.

 The involvement of JAKIM to confirm the status of Halal on consumer food products and goods in
the country began in the year of 1974.
 Research centre of Islamic Affair Division of the Prime Minister’s Office started to issue Halal
certification letters for products that met the criteria.
 Starting from 1994, Halal confirmation was given in the form of a certificate with a Halal logo, with
effect from 30 September 1998, Halal inspections were carried out by Ilham Daya, a company
appointed by the government.
 On 1 September 2002, the government announced that all Halal certification activities will
conducted by JAKIM’s Food and Islamic Consumer Product Division which comprised only 28
positions.
 Due to rapid development of the food industry in this country and in order to meet the needs of the
Muslim population, Public Service Department of Malaysia approve 165 positions and create Halal
Hub Divisions.

 It provides enforcement and monitoring programme to protect Halal integrity, Halal logo and
consumers’ interest.
 The ministry is responsible for the enforcement of the Trade Description Act 2011 and its
subsidiary legislation including investigation and prosecution of offences related to Halal laws
violations.

 The role of the Ministry of Health in the Halal industry is being played by three (3) agencies;
(1) Chemistry department, (2) The food safety and quality division (FOSIM), (3) National
Pharmaceutical Control Bureau (NPCB).
 The Department of Chemistry is the leader in Halal product analysis and traceability.
They specialise in meat specification / DNA function as well as research and product quality
assurance.
 The Food Safety and Quality Division is responsible to ensure and uphold the
nation’s integrity in food safety and quality by virtue of the powers vested upon them by the
Food Act 1983 and Food Regulation 1985.
 Through FOSIM (Food Safety Information System), importers can manage food
importation activities using ICT effectively. FOSIM actually operates as intelligent web-based
information system enhancing management of food safety.

 The National Pharmaceutical Control Bureau (NPCB) was set up to implement
quality control on pharmaceutical products including halal pharmaceutical products.
 The bureau has the responsibility to ensure the quality, efficacy and safety of pharmaceuticals
through the registration and licencing scheme through evaluation of scientific data and
laboratory tests on all products before they are marketed to the consumers.

AND AGRO BASED INDUSTRY
 The Department of Veterinary Services is responsible for the welfare of animals and
livestock industry in Malaysia.
 The department provides quality veterinary services as an assurance for public health and
sustainable livestock industry for the sake of human welfare.
 The Department is responsible for the enforcement of Animal Acts 1953 (revised 2006),
Animal Rules (1962), Animal (importation) 1962, and Abbatoirs (Privatization) Act 1993.
 In relation to the Halal industry, the Department is working together with JAKIM in the
monitoring of the operation of Halal – certified abattoirs in Malaysia.
