 FUNCIONES DE LA CIDH

La Corte Interamericana es uno de los tres tribunales

regionales de protección de los derechos humanos,
conjuntamente con la Corte Europea de Derechos
Humanos y la Corte Africana de Derechos Humanos y de
los Pueblos. Es una institución judicial autónoma cuyo
objetivo es aplicar e interpretar la Convención
Americana. La Corte Interamericana ejerce una función
contenciosa, dentro de la que se encuentra la resolución
de casos contenciosos y el mecanismo de supervisión de
sentencias; una función consultiva; y la función de dictar
medidas provisionales.

Funciones y Competencia
La Corte ejerce 2 tipos de funciónes que son:

función consultiva

artículo 64 de la Convención.

Funcion jurisdiccional
1. Su función jurisdiccional se rige por las
disposiciones de los artículos 61, 62 y 63 de la
Convención

 FUNCION JURISDICCIONAL

Se refiere a la función contenciosa de este órgano. Se

encuentra estipulada en los artículos 61º a63º de la
Convención Americana de Derechos Humanos.De
acuerdo a estos artículos, la Corte IDH tiene
competencia para conocer casos en los cuales sealegue
que uno de los Estados partes ha violado un derecho o
libertad protegidos por laConvención Americana sobre
Derechos Humanos

Derechos Humanos es eminentemente jurídica, y
según el propio Tribunal en el ejercicio de la misma no
está llamado a resolver cuestiones de hecho, sino a
desentrañar el sentido, propósito y razón de las

 MEDIDAS PROVISIONALES

Además de estas dos funciones, la Corte IDH también

tiene la facultad de dictar medidasprovisionales en
casos de extrema gravedad y urgencia, esto con el fin de
evitar que ocurran dañosirreparables a las víctimas u
ofendidos6 .Los tres requisitos: 1) extrema gravedad, 2)
urgencia, 3) necesario para evitar daños irreparables
alas personas, tienen que comprobarse, prima facie,
para que se otorguen estas medidas.
