DEFINITION OF OBLIGATION
2 An obligation is a juridical necessity to give, to do or not to do.

3. The principle of obligatory force of contracts provides that the parties are free to
stipulate terms and conditions provided it is not contrary to law, morals, good
customs, public order, or public policy.
4. The acquittal of the accused automatically absolves the accused of criminal and
civil liability.

ARTICLE 2143. The provisions for quasi-contracts in this Chapter do not
exclude other quasi-contracts which may come within the purview of the
preceding article.

Five years have passed since Harry went to Odiongan. Severus, a neighbor, saw the deteriorating state of
the property. Out of concern, he hired two workers to clean the house of Harry, paying them P500 each.

reimbursement of P1,000.
Harry refused, arguing that he did not authorize Severus to incur such expense.
LJ, their neighbor, is in the meantime, alone in her house and is craving for pizza, but does not have extra
money to spend, and does not have someone who would buy pizza for her. To her surprise, a 12-inch
Hawaiian pizza was delivered to her doorstep, with a note “Happy Valentine’s Day”. Thinking that a
secret admirer sent the pizza to her, she immediately consumed the 12-inch pizza.
The mistake was later on discovered. Can the pizza company recover from LJ?

ARTICLE 1178. Subject to the laws, all rights acquired in virtue of an obligation are
transmissible, if there has been no stipulation to the contrary.
