Judicial Power
 Is the system of courts that interprets and applies the
law in the name of state

 It provides mechanisms for resolution and disputes

 Judicial power rests with the supreme court and the


lower courts

 It is the highest court

 It is composed of a chief justice and 14 associate justices

 Functions: Judicial and administrative

 Has an administrative supervision over all courts and the personel


Qualifications of the members of the
Supreme Court
Article 8, section 7, paragraph 1

• Natural born Filipino citizen

• At least 40 years old

• Must have been 15 years or more a judge of a lower court or


engaged in the practice of law in the Philippines

• Of power competence, integrity, and probity.


Qualifications of the members of the
Supreme Court
Article 8, section 7, paragraph 2

Provides that the “Congress shall prescribe the qualifications of judges


of lower courts, but no person may be appointed judge thereof unless
he is a citizen of the Philippine Bar”

Meanwhile, Section 9 stipulates that “the members of the supreme


court and judges of the lower court shall be appointed by the President
from a list of at least three

 It is the second highest judicial
court

 Consists 68 associate justices

Sandiganbayan
 A special court which was established to decide criminal and civil
cases against government officials and employees accused of
graft and corruption and similar cased.

 People’s advocate
Court of tax Appeals
 Is a special court of limited jurisdiction, and has the same level
with the court of appeals.

 Involves criminal violation and collection of revenues under the


National Internal Revenue Code and Tariff and Customs Code.

 Consist of 8 Associate Justices and 1 presiding justice


Regional trial courts
 Was established among the region of the republic.

 Its function is to exercise exclusive jurisdiction in all criminal


cases not within other courts, except those falling under the
exclusive and concurrent jurisdiction of the Sandiganbayan.

 RTC holds cases of serious crimes like murder, robbery and such
Shari’a District Court
 It is a special court, equivalent to the Regional Trial Courts
established in specified provinces in Mindanao where the code of
Muslim Personal Laws of the Philippines is being enforced.

 Is of limited jurisdiction.

 It is composed of 5 Shari’as District Courts and 51 Shari’a Circuit


Courts.

 Decisions of the Shari’a District Courts shall be final.


The Chief Justice
 Appointed by the president based on the nominees prepared by
the Judicial and Bar Council.

 Retirement age: 70 ; no term limit

Issues
The Philippines judicial system is far from perfect
as it continues to face several issues and
problems.
Questions on judicial independence and the
manner of appointments; negative perception on
delivering justice; delay and inefficiency in the
administration of the judicial system; and people’s
accessibility to courts, among others.
Challenges
“The judicial system generally is plagued by problem
ranging from limited access to justice by the poor
chronic inefficiency and widespread
Perception of corruption and political interference’’

The Philippines have far less access to justice as


compared to those who have connections and who
make use of the system to their advantages. High level
corruption is rarely prosecuted.
Prospect
The prospect of judicial reform does not only
concern the judiciary. Other organizations and
agencies are also important in this respect. You
