ARGUMENT 1
 The first house disagree on the plan of a non-party presidential candidate
Because the discourse will reduce the dominance of political parties as a means of political
recruitment at the national level. As far as I know, the presidential and vice-presidential
candidates need to form a coalition of political parties to get more votes in parliament, the reason
political parties form a coalition is because of the presidential threshold, plus the condition that
the presidential candidate must be carried. by a political party with a minimum of 20 percent of
the seats in parliament. And also by implementing an independent presidential nomination
system without political parties, it is not ideal with the trias politica adopted by Indonesia. In
addition, independent candidate pairs or without political parties will have a negative impact on
the government and also in modern democracy in Indonesia. In short, the DPR firmly disagrees
with the presidential nomination without a political party.

ARGUMENT 2
Rules regarding presidential and vice presidential candidates must be
submitted from political parties sued to the Constitutional Court
(MK). A number of other articles in Law Number 42 of 2008
concerning the General Election of the President and Vice President
(Presidential Election Law) were requested for testing by the
Independent People's Government Committee and individual
applicants on Monday in the Courtroom of the Constitutional Court
Panel.

ARGUMENT 3
In our opinion, we do not agree with the presidential nomination without a political party in the presidential
election. Things like this are not in line with our country's constitution. The legal basis states that a presidential
candidate can only be appointed through a political party or coalition of political parties. Article 5 explains that
political parties or coalitions of political parties can nominate prospective candidates as referred to in article 4.
Then, article 6 explains that the determination of prospective pairs of candidates is carried out democratically
and openly in accordance with the internal mechanism of the political party concerned. This aims to open the
faucet of a more inclusive candidacy. Ladies and gentlemen, as a country that adheres to the distribution of
power based on the trias politica, the promotion of state leaders from an independent path still cannot be
implemented in Indonesia. If things like this are forced, then the executive will become unstable, when the
president gets criticism and pressure from the legislature. Because the president has no connection with political
parties based in the legislature. So, in the development of modern democracy in Indonesia, political parties are an
important requirement for modern democracy. We expressly reject here no presidential nomination without a
political party.
