Head of the government of the province

(Chief Minister)

Introduction
• According to 1973 Constitution provincial government performs its
function through chief minister. He is the leader of house in province.
• Relevant Provisions: 130, 131,136, 137.
Election of the Chief Minister
• Chief Minister is appointed by the Governor from amongst the members of
Provincial Assembly who in the opinion of Governor is likely to command
the confidence of the majority of the members of Provincial Assembly.
• Article 130(3): After the election of the Speaker and the Deputy Speaker,
the Provincial Assembly shall, to the exclusion of any other business,
proceed to elect without debate one of its members to be the Chief Minister.
4): The Chief Minister shall be elected by the votes of the
majority of the total membership of the Provincial Assembly.
Qualifications for the Candidate
• He should be citizen of Pakistan.
• Should not be less than 25 years of age.
• Should be sound minded.
• His name should be in electoral roll.
• Should not hold any office of profit under service of Pakistan.
Oath: CM shall take oath of office before the Governor of the Province.
Procedure of vote of no-confidence

• A resolution for vote of no-confidence can be moved against CM by not


less than 20% of the total membership of the Provincial Assembly. The
resolution shall be voted upon after the expiration of three days but before
seven days from the day on which such resolution is moved. If the
resolution is passed by a majority of total membership, CM shall cease to
hold office.
Powers and functions
• Executive Powers;
• CM has all the executive powers in the province. He is responsible for all
administrative matters of the province. He is also responsible to maintain law
and order in the province.
• Power of appointment;
• The judges of High Court are appointed on the advice of CM. He also
appoints ministers. After inserting article 175A the appointments of the
judges is the power of judicial commission.

• Legislative Powers;
• CM being the leader of the majority party in the provincial assembly has legislative
powers. No bill can be passed without the consent of CM.
• Financial Powers;
• The annual budget is prepared under the supervision of the CM.
• Dissolution of the provincial assembly
• Governor dissolves the provincial assembly on the advice of the CM. If the Governor
does not dissolve the Assembly it shall stand dissolved after 48 hours of such advice.
