INTRODUCTION

 In Malaysia, there are two Acts focusing on


the staff welfare and protection in cases of
accidents.

 These Acts are:


1. Employment Act, 1955 and
2. Social Security Act, 1969

 These Acts stipulates the duties of the


employer in ensuring the welfare of the
employee and given adequate protection

EMPLOYMENT ACT 1955

 The purposes of this Act are:


1. Outlines statutory provisions related to employment

1. Protect the rights of the workers employed by


the employee

 The Act is applicable in West Malaysia only


INTERPRETATION

 Em ployee – any person who has entered


into a contract of service;
# Salary < RM 1,500/month
For the following employees, there is no
minimum salary scale:
1. Manual labour
2. Handling/operating transportation
vehicles (goods/people) for commercial
3. purposes Supervisor for manual labour
INTERPRETATION

4. Supervising or monitoring manual labour that


has been employed under the same employer

5. In any field in any ship registered in Malaysia


(except officer under the United Kingdom
Commercial Shipping Act or Commercial Shipping
Ordinance 1952)
INTERPRETATION

 Em ployer – any person who has entered


into a contract of service to employ another
person as an employee including agent and
manager
 P lace of em ploym ent – any place where
work is carried on for an employer by an
employee
 Contractor – any person who contracts a
principal to carry out the whole or any part of
any work undertaken be the principal
INTERPRETATION

 Contract of service – any agreement,


whether oral or in writing and whether
express or implied, whereby one person
agrees to employ another and the other
agrees to serve as an employee

WORKER SOCIAL SECURITIES ACT

 SOCSO is the Social Security Organisation

 The purposes of this Act are:


1. To give social security protection in a
certain contingency

2. To outline provisions for certain issues that


are related
APPLICATION

 All industries with one or more worker;


* All workers applicable under this Act must be
insured
 Industry – any business, commerce,

manufacture of good and others

Exceptions to term industry:


Government and mobile hawkers
APPLICATION

 This Act does not cover or give protection to certain


categories of workers. Among them:
 Starting salary over RM2,000/monthly (optional)
 Wife or main/current employer
 Temporary workers (no connection with protected industries)
 Confinements (prison/school/camp/hospital)
 Police/army officer
 Domestic maids
SOCSO PROTECTION SCHEME

 There are two types of SOCSO Protection


Schemes:

1. Employment Injury Insurance Scheme

2. Invalidity Pension Scheme


PROVISIONS OF THE ACT

Among the provisions of the SOCSO Act are:


1. Insurability and Compensation
2. Benefits
3. Administration, Finance and Audit
4. Settlements of disputes and
5. compensation Penalties
6. Miscellaneous
PROVISIONS RELATED TO SAFETY,
HEALTH & WELFARE
Among the provisions are:
1. Payment of benefits or pension to contributor
in cases of:

* Accidents due to work/work related activities,


including road accidents, occurring during work
and any industrial diseases (27 types) as listed in
the Fifth Schedule (Section 28)

2. Invalidity pension

3. Organisation (SOCSO)
CONCLUSION

 All the Acts that have been introduced, i.e.


Employment Act 1955 and the Social
Securities Act 1969 (Amendment) 1992 are
aimed at protecting and ensuring the rights of
employees
