The Legal Bases of Special Education

It is important for us to have knowledge about the legal bases for special
education because it serves as a guide to the teachers on how to properly deal
with students.
Understanding these legal foundations can assist
us in determining what the teacher is required to
accomplish or vise versa.
Special education in the Philippines is anchored on fundamental legal
documents that presents a chronology of events on the growth and
development of the program.
ARTICLES 356 AND 259 OF COMMONWEALTH
ACT NO. 3203
• The Right Of Every Child to Live in an Atmosphere Conducive to his
Physical, Moral and Intellectual Development" and the Concomitant Duty
of the Government "to Promote the Full Growth of the Faculties of Every
Child."

REPUBLIC ACT NO. 3562

An act to promote the education of the blind in the


Philippines.

Enacted on June 21, 1963

REPUBLIC ACT NO. 5260

An Act Establishing A Ten-Year Training Program for teachers and led to the admission of
children with disabilities into regular public schools.
Signed into law in 1968
However, without appropriate school and parental support, this has difficulty coping with the
regular classes.
SECTION 8, ARTICLE XV OF THE 1973
CONSTITUTION OF THE PHILIPPINES

relevant to the goals of national development.
• All institutions of the higher learning shall enjoy academic freedom

PRESIDENTIAL DECREE NO. 603
“THE CHILD AND YOUTH WELFARE CODE” OF
1978
• Signed by President Ferdinand E. Marcos on December 10,
1974
• Mandated to coordinate implementation and enforcement of all
laws.
• To formulate, monitor and evaluate policies, programs and
measures for children.
PRESIDENTIAL DECREE NO. 603
ARTICLE 3 “THE RIGHTS OF A CHILD”
• The emotionally disturbed or socially maladjusted child shall be treated with sympathy
and understanding and shall be given the education and care required by his/her particular
condition.

ARTICLE 74 “SPECIAL CLASSES”

Where needs warrants, there shall be atleast special classes in


every province, and if possible, special schools for the physically
handicapped, mentally retarded, emotionally disturbed and the
specially gifted.
PRESIDENTIAL DECREE NO. 1509 OF 1978

• Created the National Commission Concerning Disabled Persons (NCCDP)


• Renamed as the National Council for the Welfare of Disabled Persons (NCWDP)
• It was created to formulate an advocate policies according to internationally and
nationally accepted standards in the areas of prevention of the causes of disability,
rehabilitation and equalization of opportunities for the persons with disabilities or PWDs.
EDUCATION ACT OF 1982
“BATAS PAMBANSA BILANG 232”
The state shall promote the right of every individual to relevant quality
education regardless of sex, age, breed, socioeconomic status, physical and
mental condition, social and ethnic origin, political and other affiliations.
It shall promote and maintain equality of access to education as well as
enjoyment of the benefits of education by all its citizens.

1987 CONSTITUTION ARTICLE XIV
SECTION 1 AND 2
Section 1
• Declares that the state shall protect and promote the right of all citizens to quality
education at all levels and shall take appropriate steps to make the education accessible to
all.
Section 2
• The state shall provide adult citizens, that disabled and out-of-school youth with training
in civics, vocational efficiency, and other skills.
REPUBLIC ACT NO. 7610 OF 1992

An act providing for strong deterrence and special


protection against child abuse, exploitation, and
discrimination providing penalties for its violation.
THE NEWBORN SCREENING ACT OF 2004

• It is a test done on a newborn baby before the baby 24 hours after birth to check for a
serious condition on a baby.
It checks for serious condition on your baby. It is
important because if a bqby has one of these
conditions, the baby might not show any symptoms
right away.
