PNP Personnel Involved
The prosecutors in a joint resolution dismissed the complaint against ELVIN ROY MAGPILI LACBAY @ JOPET on the ground of extinguishment of criminal liability based on Article 89 of RPC- Death of the convict extinguish criminal liability.
On the other hand, the complaint against @ MEC MEC was also dismissed without prejudice to its refiling because of uncertainty of the identity of the suspect @ Mec Mec.
JUSTIFICATION
PCpl Alvin Padallan has no material participation in the filing of the complaint
that is because the arresting officers against the suspects were the Team of
Provincial Intelliengence Unit of Laguna PPO named PSSg Leoncio Ordenes
and PCpl Jose Febrahin Decinella.
Further, the dismissal of the complaint against @ MEC MEC was because of
unknown identity of suspect @ MEC MEC as cited in the resolution. PCpl
Padallan has no personal knowledge in so far as the identity of the suspects is
concerned.
Therefore, PCpl Alvin Padallan could not be held liable for the dismissal of the
complaint against alias MEC MEC.
As to PSSg Jun Bannagao
PSSg Jun Bannagao was the Duty Investigator of Santa Cruz MPS when the
buy-bust operation resulting in an armed confrontation was occurred.
It was PSMS Emil Medina, PIB Investigator, who conducted investigation with
regards to the buy-bust operation they had lodged against the suspects.
PSSg Bannagao could not identity alias Mec-Mec as he has no personal
knowledge or verified information against Mec-Mec. It was the
arresting officers who should know the suspects who are non-residents
of Sta. Cruz, Laguna.
