Why is Kashmir
controversial?
 The area was once a princely state called
Jammu and Kashmir, but it joined India in
1947 soon after the sub-continent was divided
up at the end of British rule.
 India and Pakistan subsequently went to war
over it and each came to control different parts
of the territory with a ceasefire line agreed.
What is article
370?
Article 370 gave special status
to Jammu and Kashmir, a region
located in the northern part of Indian
subcontinent.

Itallows to establish a separate


constitution and a separate flag.
When was it
implemented?
 ARTICLE 370 of the Constitution of India
was a 'temporary provision implemented by
Maharaja Hari Singh on 17 October 1949
which gave special powers to the state of
Jammu and Kashmir.
When was it
revoked?
On 6th August 2019, the
bill for the reorganization
was debated and passed by
the Lok Sabha with 86%
votes in its favor and 14%
against it.
WHY WAS IT REMOVED?

Why was it not removed
earlier?
 Under article 370, there was a provision of removal of
article 370 in which it was stated that the article can be
removed by president of India only after taking permission
from constitutional assembly of J&k.

 Since, this assembly got dissolved earlier in 1957, none of


the Govt succeed to remove the article.
Impact of Abrogation of
Article 370 on J&K:
 Empowerment of people.

 Removal of unjust Laws.

 Bringing in equity and fairness.

 Conduct of elections of Panchayati Raj Institutions such


as Panches and Sarpanches, Block Development
Councils and District Development Councils
 Under article 370, there was a provision called article
35A which was issues by presidential order in 1954 by
Dr Rajendra Prashad.
 It created discrimination among the people living in J&K
as it used to decide whether or not a person is permanent
resident of J&K.
Special  Due to this, the special rights were given only to the

Status of J&K permanent resident of J&K and on the other side, the
people who are not permanent resident of J&K has to
face many limitation.
 The provision was a discriminatory for women as their
fundamental rights get termination under J&K
constitution as soon as they get married with a non-
Kashmiri.
Speed-breaker in development

Due to article 370, any non-Kashmiri was not allowed to buy land in
J&K and could not be permanent resident of J&K.

Since they could not become permanent resident of J&K, they were
given limited rights as per the rulebook of article 370.

Due to such limitations, well qualified doctors, teachers refused to go


to J&K which impacted the medical and education sector.
Kashmir after removing article 370

Indian National flag cannot be insulted anywhere in India and Kashmir.

The essential privilege the Hindus and Shiks living in Jammu And Kashmir will get will be
eligible for a 16% reservation.

After the removal of article 370, all the orders issued by the supreme court will be liable
for Kashmir.

Earlier, the residents of Kashmir had two citizenship, but after the removal of 370, now
everyone living in J&K are Indians.
Conclusion of Article 370
The removal of Article 370 has been beneficial for
everyone in J&K as it has given them the right to reach
the right person to convey their issues.

Not only this, but it has also stopped the terrorist


incidents which used to happen daily before the step of
revocation of Article 370 was taken.

After the removal of article 370, the whole nation will


follow the slogan one nation, one flag, and one
constitution.
