• In general is a tract of land parcelised into two or more lots

• no street or open space is delineated

• a tract or a parcel of land registered under Act No. 496 which is partitioned
primarily for residential purposes into individual lots with or without
improvements thereon and offered to the public for sale, in cash or installment
terms. It shall include all residential, commercial, industrial and recreational areas
as well as open spaces and other community and public areas in the project

• Subdivision and Condominium Buyer’s Protective Decree

• The primary purpose of this law is to protect buyers’ welfare from


all types of real estate misrepresentations. The state has passed to
resolve the numerous fraudulent reports about  real estate
problems in the country.

• Under the government of the late President, Mr. Ferdinand E.


Marcos, Presidential Decree 957 is passed to closely supervise and
regulate real estate practitioners, owners, and developers in the
Philippines. It is initiated and signed by the late president on July
12, 1976 in Manila.

• It aims to control and prevent “reneged on representations and obligations,”


“swindling and fraudulent manipulations,” and “failure to deliver.”
• It consists of rules and regulations on buying and selling a house or condominium,
from the point of sale to turnover of unit to property title of ownership. It also states
the other laws governing the after-sale rights of buyers and developer’s obligations.

• It specifies details pertaining to policies in dealing with real estate practitioners such
as developer, dealer, broker, and salesman or agent.

• It empowers the National Housing Authority (NHA) to have “exclusive jurisdiction to


regulate real estate trade and business.” At present, Housing and Land Use
Regulatory Board (HLURB) is now the key government agency to implement this law.

• It enumerates the process and procedures of registration, as well as the sanctions


and penalties for any unauthorized transactions made by real estate practitioners.

Important documents
• Certificate of Registration. HLURB releases this when the developer
passes the required standard to develop projects in accordance with
Subdivision Standards and Regulations for horizontal developments, or
of the National Building Code for vertical development.
• License To Sell. Once registered, HLURB releases this for developers to
sell units. The certificate is issued upon assurance of the developer’s
capacity to deliver and free from any fraudulent act.
• HLURB ID/ Certificate of Registration for Dealer, Broker, and
Salesman. HLURB mandates all dealers, brokers, salesmen or agents
who are engaged in selling subdivisions or condominiums to register.
The registration is good for 1 year and subject for renewal to
continually engage in real estate deals.

Housing & Urban Development Coordinating Council

• The Housing and Urban Development Coordinating


Council (HUDCC), under the immediate control and
supervision of the President of the Philippines, is
charged with main function of coordinating the
activities of the government housing agencies to
ensure the accomplishment of the National Shelter
Program (assists homeless – especially Informal
Settlers).

Housing & Land Use Regulatory Board (HLURB)

The Housing and Land Use Regulatory Board (HLURB) is the


country’s primary government agency tasked with providing
technical support in matters including, but not limited to: housing
regulations, land development and homeowners associations,
and settlement of land disputes. HLURB operates via a triad of
strategies: policy development, planning and regulation.

Its services cater to home buyers, developers, homeowners


associations, brokers and local government units.

Department of Human Settlements and Urban Development

DHSUD was a merger of the HUDCC and the Housing and Land Use
Regulatory Board (HLURB), with the former becoming defunct and
the latter reorganized as the Human Settlements Adjudication
Commission (HSAC).

The law creating the Department of Human Settlements and Urban


Development (DHSUD), Republic Act No. 11201, was signed into
law by President Rodrigo Duterte on February 14, 2019, with the
signing announced to the public by the government on February
19, 2019.
Home Guaranty Corporation
• The Home Guaranty Corporation (HGC) is the
government-owned-and-controlled corporation (GOCC)
mandated by law (RA 8763) to promote sustainable home
ownership by providing risk coverage or guarantees and
tax/fiscal incentives to banks and financial
institutions/investors granting the different facilities

• Encourage the flow private funds for mass housing


development and homebuyers' financing through a viable
system of mortgage and credit guaranty
National Housing Authority
• Under PD 757 dated 31 July 1975. NHA was tasked to
develop and implement a comprehensive and integrated
housing program which shall embrace, among others,
housing development and resettlement, sources and
schemes of financing, and delineation of government and
private sector participation.

• A viable organization that leads in the provision of


comprehensive and well-planned human settlements for
the homeless, marginalized, and low-income families,
thereby improving their quality of life.
National Housing Authority
• "Zonal Improvement Program or ZIP" refers
to the program of the National Housing
Authority of upgrading and improving blighted
squatters areas within the cities and
municipalities of Metro Manila pursuant to
existing statutes and pertinent executive
issuances.
Social Housing Finance Corporation
• Under E.O. 272, the SHFC shall be the lead government agency to undertake
social housing programs that will cater to the formal and informal sectors in
the low-income bracket and shall take charge of developing and administering
social housing program schemes, particularly the CMP and the AKPF Program
(amortization support program and development financing program).

• The Community Mortgage Program (CMP) is a mortgage financing program of


the Social Housing Finance Corporation (SHFC) which assists legally organized
associations of underprivileged and homeless citizens to purchase and develop
a tract of land under the concept of community ownership. The primary
objective of the program is to assist residents of blighted areas to own the lots
they occupy, or where they choose to relocate to and eventually improve their
neighborhood and homes to the extent of their affordability.
