Program
Should the school have a Child Protection Policy?

 YES, this document, known as the School Child Protection Policy or SCPP together with the Anti-Bullying
Policy, pursuant to DO No. 40 s. 2012 and DO 55 s. 2013, forms part of the documentary requirements and is
included in the Student/School Manual. The SCPP document should be posted in the school’s bulletin board
and should contain the names and contact numbers of the members of the Child Protection Committee.

 The Schools Division Office shall check the submitted SCPP pursuant to their mandate provided under DO
40 s. 2012.
What are the requirements for Contract of Lease?
 Contract of Lease for a period of at least 5 years with a definite feasible plan for:
(1) the acquisition of its own school site within five (5) years from the date of filing of the application
for permit to operate;
*term of the contract (with option to buy) for at least 5 years and
(2) construction of school buildings/facilitaties on said school site within ten (10) years from the said
filing of the application for permit to operate (pursuant to DO 11, s.2011)
Can the Occupancy Permit be replaced by Certificate of
Structural Stability signed by City Engineer? Annual Inspection
Report by the City Engineer?

No. Let us still require Occupancy Permit but if the applicant private school cannot submit the
same within the prescribed period, a proof of the pendency of application of the same shall be
submitted, i.e., Certification from the City/Municipal Building Official, AND a verified Certificate
of Structural Stability issued by Licensed Structural Engr.
Can the requirement for Administrative Officials’ documents like
NBI and Police Clearance be removed?

NO. Administrative Officials shall be of good moral character per Section 55 of

DO 88, s. 2010.
What is the Kindergarten classroom size and ratio?

Per DO 47, s. 2016 the prescribed classroom size is 7x9 or 63 sq.m. for a
ratio of 1:25 to 1:30 classroom-student ratio or 2.52 - 2.1 sqm/student.
For Recognition, what are the requirements on school site?

School Site ownership is a must except if duly exempted by the Secretary

(Sec. 160, DO 88 s. 2010)
Do the Usufruct (of Congregation?) and long-term lease need an exemption
from the Secretary of Education?

Actually, there is no mention of usufruct or long-term lease in DO 88, 2010.

However, it is noted that in certain cases, the Secretary issued exemption as
regards school site ownership to schools who are holder of a usufructuary or
leasehold right for at least a period of not less than 25 years.
Must the TCT and address of the school be the same?

YES. If there is discrepancy, the applicant school must show proof that the
address in the TCT and the actual/current address is one and the same. As
much as possible, the property (building and lot) shall be in the name of the
School.
For Re-issuance of Government Recognition, what are the requirements if a
school transfer to another location?

Stick to Sec. 37 on Transfer of School (recognition cancelled with proviso)

“The government recognition of a school which is transferred to another location is

deemed cancelled: Provided however, that the government recognition may be
retained, as an exception if the new site and campus school buildings and quarters are
found to be much better than the former, and if all other standards have been
satisfactorily maintained. “
Is the Senior High School Program allowed in the Homeschooling
Program?

 DO 1 s. 2022 or “Revised Policy Guidelines on Homeschooling

Program” under Provisions for Private Schools in page 13 states
clearly that Private Schools with Recognition can offer home
schooling programs for K-10 only. (Expressio unius, exclusio
alterius which means what is not included is deemed excluded.)
 In page 8, the operative word is “may”
Are those living abroad, allowed to enroll in the Homeschooling Program?

 In page 21, “Homeschooling Program Form,” one of the reasons stated for
Homeschooling my child is LIVING ABROAD.

 Comment: One way of ascertaining if the child is within the Philippines. If

the child is living abroad, then deny the application.
