WHAT IS CONSTITUTION?
• System of Fundamental laws and principles of
government of a nation, corporation or other
aggregation of individuals which may either be
written or unwritten.
• Supreme law/ fundamental law of the land.

WHAT THE CONSTITUTION DOES?


1. Establish a government for the State
2. Delegate to the Government certain, limited and
enumerated powers.
3. The people are the “boss” of the government
4. The people hired the government and set forth the
rules as to how it should operate.
5. The people are the rightful and logical enforces of
the Constitution.
WHAT THE CONSTITUTION DOES NOT? 02

1. Does not give the people rights


2. The people rights are considered to be “God-
Given” or natural rights.
3. The people are born with all their rights.
4. The Constitution, does, however protect their
rights.
5. Limiting the powers of government by granting to
it only the specific powers that are listed in the
Constitution.

WHAT THE CONSTITUTION DOES NOT?


6. Enumerating certain, specific rights which the
people retain ( listed in the Bill of rights)
-The bill of right says that even though a particular
right is not listed, the people still retain the right.

• Without the Constitution, the State and the people


have all the rights and there is no Government.
• With the Constitution, the State and the people keep
any rights not specifically delegated to the
government by the Constitution.

A Consti is divided into 3 Major Parts:


1. The Constitution of Government( Article
VI,VII,VIII and IX) establishes or creates a major
organ of thr government
2. The Constitution of Liberty (Article III) individual
rights which also may be invoked against the
massive powers of the govt. in case of arbitrary and
abusive exercise of these power.

3. The Constitution of Sovereignty ( Article XVII)


-spells out the authority of the people to approve,
amend or revise the Constitution in a plebiscite or any
political exercise which require the participation of the
people.

A good written Constitution must possess the following


virtues:
Broad-in its scope because it is outlines the org. of the
government for the whole state.
Brief- The details of the org. should not be too detailed in
form.
Definite- foreclosing as much as possible the
incorporation of vague, ambiguous and contradictory
matters ( to avoid misinterpretation)

What is PREAMBLE???
• An introductory statement in a document that explains
the document’s purpose and underlying philosophy by
the power of ordaining it.
• Not considered as a source of substantive law unless
apart from the preamble since it is not part of the
constitution but a prefatory portion of it.

• A clause at the beginning of the Constitution or statute


explaining the reasons of its enactment and the
objectives it seeks to arttain.
• When compared to a house, the preamble is a mere
doormat .

What is PREAMBLE??

• Latin word: “ preambulare”


• To walk before
• Background of why the consti was enunciated
• States the origin and purpose of the constitution
• Aids the interpretation of the constitution.

We, the sovereign Filipino people, imploring the


aid of Almighty God, in order to build a just and
humane society, and establish a government that
shall embody our ideals and aspirations, promote
the common good, conserve and develop our
patrimony,

And secure to ourselves and our posterity, the


blessings of independence and democracy under
the rule of law and a regime of truth , justice,
freedom, love, equality and peace do ordain and
promulgate this Constitution.
