FOR ENVIRONMENTAL
CASES
Administrative Matter No. 09-6-8-SC
Verified complaint - shall state that it is environmental case and the law violated. I
shall include a certification against forum shopping.
Who may file -Any real party in interest, including the government and juridical
entities authorized by law, may file a civil action involving the enforcement or
violation of any environmental law:
Citizen suit - any Filipino in representation of others, including minors or
generations yet unborn, may file an action to enforce rights or obligations under
environmental laws.
Issuance of Temporary Environmental Protection Order (TEPO) – effective only
for 72 hours but may be extended upon summary hearing, if warranted, until the
termination of the case.
Prohibition against Temporary Restraining Order (TRO) and Preliminary Injunction.
Pre-Trial (Rule 3)
Referral to mediation (Sec.3) court shall refer the parties or
their counsel, if authorized by their clients to the Philippine
Mediation Center for purposes of mediation; It shall be
conducted within a non-extendible period of 30 days from
receipt of the referral to mediation.
Pre-trial Conference; Consent Decree - all the parties and
their counsels are placed under oath, and remain under oath in
all pre-trial conferences. The court may exert effort to persuade
the parties to settle the dispute and may issue a consent decree
approving the agreement.

Strategic Lawsuit against Public Participation -
legal action filed to harass, vex, exert undue pressure
or stifle any legal action by the government shall be
treated as a SLAPP. Hearing is conducted to proof
defense of SLAPP.

Rule 7- WRIT OF KALIKASAN
Is a remedy available to a natural or juridical person, entity, authorized
by law, people’s organization, non-governmental organization, or public
interest group accredited by or registered with any government agency,
on behalf of a person whose constitutional right to a balanced and
healthful ecology is violated, or threatened with violation by an unlawful
act or omission of a public official or employee, or private individual or
entity, involving Environmental damage of such Magnitude as to
prejudice the life or property of the inhabitants in two or more
cities or provinces.
Verified Petition
a) Contents and Certification against Forum Shopping;
b) Reliefs prayed for;
c) Exempt from payment of Docket fees.

Appeals.
Contempt
The court after hearing punish the respondent who
refuses or unduly delays the filing of the return, or make
a false return or any person who disobeys or resists a
lawful process or order of the court for indirect
contempt.
