KNOCK AND

ANNOUNCE

Cárdenas Acosta Luis Fernando

BACKGROUND
The "knock-and-announce" rule
originates from the Fourth
Amendment's protection against
unreasonable searches and seizures. In English common law has required
general, even if officers have a law enforcement to knock-and-
warrant that justifies entering a home, announce since at least Semayne's
they must announce themselves and case , the Supreme Court of the
their purpose before intruding. United States recognized that police
must give notice before making a
forced entry.
EFFECTS OF THE RULE
The knock-and-announce rule is designed only to provide
a brief moment of privacy for an individual to compose
themselves before a valid search occurs, to prevent an
individual from mistakenly believing that police are
common intruders.
RULE EXCEPTIONS
The Supreme Court held that an officer is not
required to knock and announce if doing so would
be unreasonable. This includes situations in which
officers suspect that announcing their presence
would be dangerous, futile, or result in the
destruction of evidence.
• No-knock warrant
HOW IT OPERATES
The Supreme Court has given some guidance as to how long officers
must wait after knocking and announcing their presence before entry
may be made.  Some different factors have been propounded by lower
courts to guide the analysis of a reasonable wait period
 A few examples are:
•the size, design, and layout of the premises
•the time of day the search is being executed
•the nature of the suspected offense
•the evidence demonstrating guilt.
BREONNA TAYLOR
Breonna Taylor, a 26-year-old African-American woman, was
fatally shot in her , apartment on March 13, 2020, when three
police officers, forced entry into the apartment as part of an
investigation into drug dealing operations.
Statements by the police officers and forensics reports
showed that the raid was compromised by poor planning
and reckless execution.
None of the poice officers who raided Brennona’s Taylor
home used body cameras, impending the public from a
full understanding of what happened.
The shooting of Taylor by police officers led to
numerous protests that added to those across the United States
against police brutality and racism.  When a grand jury did not
indict the officers for her death, further civil unrest ensued.
