DEFINISI MUAMALAH

Arab: Berasal dari kata ‘amala,

ETIMOLOGI yu’amilu, yg berarti berurusan,
berbuat. Jadi Muamalah adalah
saling berbuat sesama manusia

Hukum-hukum yg berkaitan dengan

TERMINO tindakan hukum manusia dalam
LOGI persoalan-persoalan keduniaan

Persolah Jual Beli, utaang piutang ,

kerjsama dagang , penggarapan Misal
tanah sewa menyewa dan lain-lain

AJARAN ISLAM
Ajaran tentang Aqidah berkaitan dengan
AQIDAH Persoalan keimanan dan keyakinan sesorang
terhadap eksistensi Allah, Malaikat, Rasul , kitab
suci, hari akhirat dll

Ajaran ttg Aqidah bersifat permanen , pasti, dan

tidak berubah disebabkan terjadinya perubahan jadi
sosial kultural manusia

Ajaran ttg ibadah berkaitan dg persoalan2

IBADAH pengabdian kpd Allah dalam bentuk2 khusus
seperti Shala, Puasa, Haji, Zakat , Puasa Dll.

Ajaran ttg Muamalah berkaitan dg persoalan2

hubungan antara sesama manusia dlm MUAMA
memenuhi kebutuhan masing2 sesuai dg ajaran LAH
2 dan prinsip2 Alquran dan Sunnah

Prinsip Dasar Muamalah

• Prinsip Dasar persolan Muamalah

adalah utk menunjukan kemaslahatan
umat manusia sesuai dg situasi&kondisi.

– Kaedahnya “ Prinsip dalam Muamalah itu

boleh, sampai ada ketentuan yang
melarangnya” 1.

• Seluruh tindakan Muamalah tdk terlepas
dari nilai-nilai Ketuhanan (az-Zariyat
56)
• Seluruh tindakan Muamalah tdk terlepas Text
dari nilai-nilai kemanusiaan dg akhlak,
• Melakukan pertimbangan atas
kemaslahatan pribadi dan kemaslahatan
masyarakat
• Menagkkan prinsip kesamaan hak dan
kewajiban sesama manusia.

Jenis-Jenis Muamalah
1. Hukumnya ditunjuk langsung oleh Nash
(al-Qur’an dan Sunnah)
Misal : Warisan, talaq, Iddah, Khuluk, Rujuk, minum
Khamar, makan Babi, keharaman Bangkai, dan
Riba. Pidana: mencuri, zina dan qazhaf
(menuduh org berbuat zina).
2. Hukumnya yg tiddak ditunjuk langsung
oleh Nash,
Misal: hasil ijtihad para ulama
