To whom it shall apply :
• apply to all Govt servants whose pay is debitable to Civil
Estimates
• not apply to Govt servants whose conditions of service are
governed by Army or Marine Regulations.

Definitions
Allotment: grant of a license to a g/s to occupy a house owned, leased
or requisitioned by the Govt for use as residence.
Cadre : the strength of a service or a part of service sanctioned as a
separate unit.
Compensatory allowance: an allowance granted to meet personal
expenditure necessitated by the special circumstances in which duty is
performed. It includes a travelling allowance, but does not include
sumptuary allowance,
Joining time: time allowed to join a new post or to travel from a
station to which he is posted.

Duty includes-
(i) Service as a probationer or apprentice provided that such
service is followed by confirmation; and
(ii) joining time.

A govt servant may be treated as on duty-


i) during a course of instruction or training in India
ii) In the case of a student, stipendiary or otherwise, who is entitled
to be appointed to the service on passing through, the intervening
period between completion of the course and assumption of duties,

Conditions for treating training as duty:
a) should be in India
b) should be connected with the current post
c) It is obligatory for Govt to send him for such training
d) Should not be professional or technical subjects
e) Period should not exceed one year

Honorarium: a recurring or non-recurring payment to a govt.
servant from the Consolidated Fund as remuneration for special
work of an occasional or intermittent character.
Fee : a recurring or non-recurring payment to a g/s from a source
other than Consolidated Fund made directly or indirectly.

Lien : the title of a g/s to hold on regular basis, either immediately


or on the termination of periods of absence, a post, including a
tenure post, to which he has been appointed on regular basis and
on which he is not on probation.

Pay : the amount drawn monthly by a g/s as-
i) The pay, other than spl pay or pay granted in view of his personal
qualifications, sanctioned for a post held by him substantively or in
an officiating capacity, or to which he is entitled by reason of his
position in a cadre
ii) Overseas pay, special pay and personal pay
iii) Any other emoluments which may be specially classed as pay.

Time scale pay: means pay which rises by periodical increments from
a minimum to a maximum. Time scale are said to be identical where the
minimum, maximum, the period of increment and the rate of increment
of the time scales are identical.
Substantive pay: the pay other than special pay, personal pay or
emoluments classed as pay to which a g/s is entitled on account of a
post to which he has been appointed substantively or by reason of his
substantive position in a cadre.
Personal Pay : Additional pay granted to g/s to save him from loss of
substantive pay.

Special pay: an addition, of the nature of pay, to the emoluments of a
post or of a g/s, granted in consideration of-
a) The specially arduous nature of the duties; or
b) A specific addition to the work or responsibility

Overseas pay: pay granted to a g/s in consideration of the fact that he is


serving in a country other than the country of his domicile.

Presumptive Pay: pay to which he would be entitled if he held the post
substantively.
Subsistence grant/Allowance: Monthly grant made to a g/s who is not
in receipt pay or leave salary.

Leave salary: the monthly amount paid by Govt to a g/s on leave

Foreign service: service in which a g/s receives pay with the sanction
of Govt from any source other than the Consolidated Fund.

Temporary post :a post carrying a definite rate of pay
sanctioned with limit of time.

Permanent post :a post carrying a definite rate of pay


sanctioned without limit of time.

Tenure post: a permanent post which an individual g/s may


not hold for more than a limited period.

Retention of lien:
A g/s who has acquired lien on a post retains lien on that post-
i) While performing duties of that post
ii) While on foreign service, or holding a temporary post or
officiating in another post,
iii) during joining time
iv) While on leave
v) While under suspension

• A permanent g/s appointed in another deptt/office may retain lien for 2


years. Undertaking should be taken at the time of forwarding
application.
• When the g/s is not confirmed in the new post within 2 years, he may
be permitted to retain lien for one more year, however, fresh
undertaking should be taken.
• Temporary g/s should resign at the time of release from the parent
post. Undertaking should be taken at the time of forwarding
application to that effect in the event of their selection and
appointment.

Service which does not count for increment

• Period of suspension treated as non-duty


• Period of E.O.L on private affairs
• Period of E.O.L on M.C or for prosecuting higher and technical
studies exceeding 6 months,
• Overstayal of leave not regularized
• Break in service

Medical Certificate

• No person may be appointed in a pensionable post in Govt service


without a medical certificate of health.
• Production of M.C on first appointment should be recorded in a
Service Book
• The whole time of a g/s is at the disposal of the Govt which pays him
and he may be employed in any manner required by proper authority
without claim for additional remuneration.

Exemptions from production of M.C
• The following classes of g/s are exempted from producing M.C-
i) recruited through competitive examinations and had undergone medical examination in
accordance with the service rules
ii) Qualified student of the Thomason College, Roorke, permanently appointed to PWD
within 18 months from the date of the health certificate granted to him on completion of
the course,
iii) g/s who has been medically examined in one office, if transferred to another office
without break,
iv) Retired g/s, re-employed immediately after retirement,
v) G/s appointed in a vacancy for a period not exceeding 3 months
vi) Person re-employed after resignation, if resignation was for taking up another
appointment under the govt through proper channel provided that he was medically
examined.

Simplified procedure for confirmation ( wef 01.04.1988)
• Confirmation will be made only once in the service of a g/s which will be in the
entry grade,
• Confirmation is delinked from the availability of permanent vacancy. Officer who
successfully completed probation will be confirmed irrespective of availability of
permanent vacancy,
• In case of direct recruitment, there should be mandatory induction training of at
least 2 weeks duration, successful completion of training should be a condition for
completion of probation,
• If R/Rs do not prescribe probation, officer promoted on regular basis will have all
the benefits that a person confirmed in that grade would have,
• If a g/s who has not been confirmed in his old post, is appointed by transfer, it
would be necessary to confirm him in the new post.

Willful absence from duty
• Willful absence from duty, even though not covered by grant of leave, does not entail loss of lien.
The period of absence not covered by grant of leave shall have to be treated as dies non for all
purposes, viz- increment, leave and pension. Such absence without leave where it stands singly and
not in continuation of any authorized leave will constitute an interruption in service for the purpose
of pension and unless commutes retrospectively such period as E.O.L, the entire past service will
stand forfeited.
• No pay for the period, even if condoned,
• Increment- will not count for increment, preceding period will not be forfeited and count for
increment,
• Leave- period of absence will not entail forfeiture of past service for the purpose of leave, leave at
credit at the time of absence will not also lapse. However, 1/10th of the period of absence in r/o EL
and 1/18th in r/o HPL will be deducted from the EL/HPL to be credited at the beginning of the
succeeding half year,
• Pension- unless A/A commutes retrospectively such period as E.O.L under Pension Rules, the past
service will not count as qualifying service for the purpose of pension.
