The Central Government introduced new four labour
codes after merging 44 laws.

CODE ON WAGES, 2019

The following Acts were repealed


1. The Minimum Wages Act, 1948
2. The Payment of Wages Act, 1936
3. The Payment of Bonus Act, 1965
4. The Equal Remuneration Act, 1976.

High lights
1. MW = BP, DA, RA
2. Wage period = 7 th day
3. MW should not be below the National Floor level
wage.
4. Bonus : Disqualification – convicted Sexual
Harassment worker not eligible
5. Deductions shall not exceeds 50 %
6. Filing Claim petition – 3 years ( 6 months deleted)
7. Claim Appeal – Appellate Authority in the Dept
notified.

Code on Social Security, 2020

The following Acts were repealed


1. The Employees' Provident Fund and Miscellaneous
Provisions Act, 1952
2. The Employees' State Insurance Corporation Act, 1948
3. The Maternity Benefits Act, 1961
4. The Building and Other Construction Workers Welfare
Cess Act, 1966
5. The Employees' Compensation Act,1923.
6. The Unorganised workers Social Security Act, 2008
7. The Payment of Gratuity Act, 1972
8. The Employment Exchanges (Compulsory notification
of vacancies) Act, 1959.
9. The Cinema Workers Welfare Fund Act, 1981 6

1. Introduces the definition of career centre for career
service.
2. Platform worker, gig workers included.
3. Social Security scheme for Unorganised workers
4. National Social Security Board and State level Social
Security Board.
5. All Registered Establishments covered under EPF and
ESI Facilities
6. Social Security Fund for unorganised Workers.

7. The Beedi and Cigar Workers Act, 1966
8. The Contract Labour Act, 1970
9. The ISM Act, 1979
10. The Cine workers and Cinema Theatre workers
Act,1981
11. The Dock Workers Act, 1986 8
12. The BOCW Act, 1996
13. The Sales Promotion Employees Act, 1976.

1. One Registration for one establishment

The following Acts were repealed

1. The Trade Unions Act, 1926


2. The Industrial Disputes Act, 1947
3. The Industrial Employment (Standing Orders) Act,
1946.

Highlights
1. Definition of Industry modified.
2. GRC members 6 to 10.
3. Prohibits Strikes and Lockout without giving notice of
14 days.
4. Notice of Strike and Lock out validity is amended 6
weeks to 60 days.
5. Raising ID before C.O reduced to 2 years from 3 years.
6. Permission of Lay off and retrenchment – 300 workers
and above
7. Reskilling fund 15 days wages for every retrenched
worker to be paid by employer
8. Recognizition Trade Union - 51 % Sole bargaining
agent; or 1 representative for 20 % of workers.
9. S.O – applicable only with 300 workers. Approval of 11
SO 60 days or deemed approval.
10. Compounding of offences introduced.
PRESENT STATUS
 Central government has already finalished he
rules under these codes
 13 states have been pre published the state
Rules for all the Four labour Codes.
 For Code on Wages - 24 states published
 For I.R Code – 20 states published
 For SS Code – 18 States published
 For OSH Code – 13 states published
 Remaining States are required to frame
regulations on their part as labour is a
concurrent subject.
 The four codes are likely to be implemented in

the next financial years of 22-23.
