Duties of employed person (s.93)
• Requirement to use appliances provided to
secure health, safety and welfare
• Not to misuse appliances provided
• To protect him/herself and other persons
• The fine for contravention is TSH 100,000 or 3
months imprisonment or both

Prohibition of deductions from wages
(S.94)
• Employer not to make any deduction from
workers remuneration
• Receive or allow any person in his employment
to receive any payment from any worker

• To promote SH and rehabilitate affected
workers
• To maintain safe plant, system and process
• To control any risk in connection of any
activities i.e. process, transport etc
• To provide instructions, training, and
supervision to ensure HS or the workers

• To maintain safe and healthier workplace
• Identify and eliminate all hazards instead of
opting to PPEs
• To make sure that the act is complied with
• To make sure that all workers are informed
regarding their scope of authority

• To make sure that all workers are conversant to
HS hazards in their workplace
• To consult the workers or SH Reps in OHS issues
• To revise OHS policy statement and objectives

• To prevent emission to the environment
• To inform in writing the SH Reps concerning
inspection, investigation, etc from inspector

• To take care of his/her safety and health and
other persons
• To co-operate with employer and any other
persons to comply with legislation
• To obey any lawful order, rules and procedures
laid down by his employer or any other
authorized person
• To report any situation (incidence, accident, to
employer or SH Reps

• To report to inspector if employer fails to
rectify any OHS problems

Victimization forbidden (S.102)
• Victimization means:
–Dismiss any employees
–Reduce rate of remuneration
–Alter terms or conditions of
employment
–Alter his position relevant to other
employees
OSHA 11
• Victimization is forbidden in case a worker:
– Has given information to minister or any other
person on OHS issues
– Has complied with a lawful prohibition requirement,
request, or direction of inspector
– Has given evidence before court of law
– Has complied with OHS legislation
– Has refused to do anything which he/she is
prohibited in the OHS act
– Has contracted occupational or any other diseases

If the employee is unable to work
by reasons of his health
condition, employer may
terminate the employee under
procedures laid down under
other legislation

• Article shall be designed and constructed safe,
without risks when properly used
• To carry out safety test of the article
• To provide safe use information incl.
inspection report
• Designer to carry out the research for purpose
of eliminating hazards

Officers SHE Committees) s.107
• Persons exercising any duty, function,
responsibility etc. given under the act
• Shall not incur any criminal or civil liability as a
result of his power
