INTRODUCTION:

The present constitution of 1973 provides the parliamentary form of


government.
Article 50 says that there shall be a Majlis-e-Shoora (parliament) consisting of
the president and the two houses to be known as the National Assembly and the
Senate. The Senate is the upper house and the National Assembly is the lower
house of parliament.
 Relevant Provisions:
Article 51,52,53,54,55,57,58, are relevant provisions of NA of Constitution of
Pakistan 1973.
 Parliament Under Constitution of 1973:
Parliament is an authoritative institution. It can enact any type of law.
Parliament in Pakistan which is known as "The Majlis-e-shoora" consists of the
President and two houses known as National Assembly and the Senate.
NATIONAL ASSEMBLY

 Qualification for Member of National Assembly:


Following are the qualification for membership of NA.
1. He must no be less than 25 years of age.
2. He must be citizen of Pakistan.
3. His name must be in electoral roll.
4. He must not hold any office of profit in service of Pakistan.
5. He must be mentally and physically fit.
 Method for Election of NA:
The members of national assembly are elected by direct election.
 Term of National Assembly:
The term of National Assembly is five ears. The term of five years shall
commence from the day of its first meeting and shall stand dissolved at the
expiration of its term.
 Quorum:
ARTICLE 55:The Quorum is one-fourth membership of the assembly.
 Summoning and Prorogation of Session:
National Assembly shall be summoned and prorogated by President of Pakistan.
 Sessions:
There will be at least three session in a year and the interval between them
shall not exceed 120 days. It is required to remain in session for at least 130
days in a year.
 Dissolution of National Assembly:
National Assembly can be dissolved by the president on the advise of Prime
Minister but Prime Minister cannot give advise when resolution of vote of no
confidence is under process in the house.
POWERS AND FUNCTIONS OF NATIONAL
ASSEMBLY

 Legislation:
The primary function of the National Assembly is to make laws. After it passed by
the Assembly it is sent to the senate for its consideration. If accepted by the
senate and finally presented to the president for approvals.
 Amendments in the Constitution:
ARTICLE 70: National Assembly has the power to amend the constitution by the
two third majority votes of its total membership.
 Administrative:
Following methods are adopted to control the administration.
• Questions
The member of NA can put questions to the minister of the concerned department.
• Resolution
NA can pass a resolution to express its view over any important matter.
• Vote of No-confidence
NA can pass a vote of no-confidence against Prime Minister.(ARTICLE 95)
• Criticism
NA can criticize the policies of the Federal Government.
 Financial Affairs:
1. ARTICLE 80:The budget is prepared under the supervision of the National Assembly.
2. ARTICLE 77:National Assembly gives its approval in all tax matters.
3. ARTICLE 82:Money bills always originate in the National Assembly.
4. ARTICLE 160:NA has power to criticize and discuss budget when it is prepared.
 Electoral Functions:
ARTICLE 41:National Assembly also elects the President of Pakistan.
ARTICLE 53:National Assembly elects its own speaker and deputy speaker.
ARTICLE 55: National Assembly elects it leader of the house, it means Prime
Minister.
 Judicial Powers and Functions:
ARTICLE 193,175(A), 205: NA determines the organization of the Judiciary and
number of judges.
ARTICLE 47:NA is empowered to proceed impeachment against the president.
CONCLUSION

To conclude I can say that parliament is the Supreme Institution of the country.
It is law making body. Its consists of the President and two houses NA and Senate.
National Assembly is directly elected by the people. The term of NA is five years.
It can be dissolved by the president. Senate is the upper house of parliament. It
consists of 100 members. Under the constitution senate can not be dissolved.
National Assembly proclaim emergency.
