FACTS:
Regina Ongsiako Reyes filed her Certificate of Candidacy (COC) for the position
of Representative of the lone district of Marinduque. Joseph Socorro Tan, a
registered voter and resident of Torrijos, Marinduque, filed before the COMELEC
a petition for the cancellation of Reyes’ COC on the ground that the COC
contained material misrepresentations regarding Reyes’ qualifications. Tan
alleged that Reyes is an American Citizen and a holder of a US passport and
used it on her various travels abroad. COMELEC granted Tan’s petition and
cancelled Reyes’ COC. Reyes won the election, was proclaimed winner and took
oath of office. With the finality of Comelec’s Resolution, Reyes filed a petition
arguing that the House of Representatives Electoral Tribunal (HRET) has the
jurisdiction on the case and not the COMELEC.
