How OSHA affects Massachusetts Municipalities
The Occupational Safety and Health Administration (OSHA) promotes and enforces safety
and health standards (regulations).

Massachusetts General Law Chapter 149, Section 6-1/2, effective Feb. 1, 2019 requires
that Public employers shall provide public employees at least the level of protection
provided under the federal Occupational Safety and Health Act of 1970.
• This means the health and safety of TOW employees is regulated by OSHA, primarily two
standards: 29CFR 1910 (General Industry) and 29CFR 1926 (Construction).

OSHA does not enforce H&S regulations for public sector employees in Massachusetts.
Regulations are enforced by The Massachusetts Department of Labor Standards (DLS).
• Enforcement through inspections and incident investigations currently is focused on high-hazard
activities: fall protection, trench excavations and confined space entry.
• A couple of sources indicate that next steps for DLS will be safety programs and training
required by OSHA standards.
