THE FACTORIES ACT, 1948.
INTRODUCTION

In India the first Factories Act was passed in 1881. This Act was basically designed to
protect children and to provide few measures for health and safety of the workers. This
law was applicable to only those factories, which employed 100 or more workers. In
1891 another factories Act was passed which extended to the factories employing 50
or more workers.
THE FACTORIES ACT, 1948.
Definition of a Factory:-
“Factory” is defined in Section 2(m) of the Act. It means any premises including the
precincts thereof-
i. Whereon ten or more workers are working, or were working on any day of the
preceding twelve months, and in any part of which a manufacturing process is
being carried on with the aid of power, or is ordinarily so carried on; or
ii. Whereon twenty or more workers are working, or were working on any day of
the preceding twelve months, and in any part of which a manufacturing process
is being carried on without the aid of power, or is ordinarily so carried on;
But does not include a mine subject to the operation of the Mines Act,1952 or a
mobile unit belonging to the Armed forces of the Union, a railway running shed
or a hotel, restaurant or eating place.

Reasons :
• Bhopal Gas tragedy occurred in 1984 (Early hours of
3.12.1984)
• Revealed the weakness in the existing law and demanded the
need to amend the law by incorporating special provisions to
deal with chemical industries and for management of chemical
accidents.

Hazardous process – defined
Hazardous Process means any process or activity in relation to an
industry categorized wherein unless special care is taken, raw materials
used therein or the intermediate products, bye-products, wastes or effluents
would ;
- Causes of material impairment to the health of the person engaged in
- Result in general pollution
29 industries have been listed as industries involving hazardous
processes.
Manufacturing Process :-
Any process for
(i) Making, altering, repairing, finishing, packing, oiling, washing,
cleaning any article.
(ii) Pumping oil, water, sewage or any other substance
(iii) Generating, transforming or transmitting power,
(iv) Printing, Book-binding,
(v) Constructing, Repairing or breaking up ships or vessels,
(vi) Preserving or storing any article in Cold storage.

Worker

A person employed directly or by or through any agency including


a contractor with or without the knowledge of the principal
employer
- in any manufacturing process
(or)
- in cleaning any part of the machinery or premises
(or)
- in any work incidental to the manufacturing process.

RESPONSIBLE PERSONS
• OCCUPIER AND MANAGER are the responsible persons for implementation of
the provisions envisaged in the Act.
• OCCUPIER means the person who has got the ultimate control over the affairs of
the factory.
• Proprietorship - Proprietor
• Partnership - One of the partner
• Company - One of the director
• State or Central Government owned - Person so nominated by the
respective government.
MANAGER means a person responsible to the occupier for the working of the
factory. He has to be nominated by the occupier.
Section 7(A)

General duties of the occupier –

(1) Every occupier shall ensure, so far as is reasonably practicable, the health,
safety and welfare of all workers while they are at work in the factory.

(2) Without prejudice to the generality of the provisions of sub-section (1), the
matters to which such duty extends, shall include –

(a) the provision and maintenance of plant and systems of work in the
factory that are safe and without risks to health;

(b) the arrangements in the factory for ensuring safety and absence of
risks to health in connection with the use, handling, storage and transport of
articles and substances;

(c) The provision of such information, instruction, training and supervision as are
necessary to ensure the health and safety of all workers at work;

(d) The maintenance of all places of work in the factory in a condition that is safe
and without risks to health and the provision and maintenance of such means of
access to, and egress from, such places as are safe and without such risks;

(e) The provision, maintenance or monitoring of such working environment in the


factory for the workers that is safe, without risks to health and adequate as
regards facilities and arrangements for their welfare at work.

RESPONSIBILITIES OF THE MANAGER

Manager is a person appointed by the occupier for the purpose of the Act.
He is a person responsible to the occupier for working of the factory for the purpose of
the Act.
Specific duties :
• Responsible to maintain all the statute registers.

• Responsible for submission of returns, accident reports, returns, etc.

• Responsible to submit notice regarding working on Sunday, over time works,


etc.

• He is jointly responsible with the occupier in implementing the applicable


provisions of the Act.

Section 21 – read with Rule 53 - Fencing of Machinery
Every moving part, every part of an electric generator, motor, transmission,
machinery, every dangerous part of any other machinery shall be securely fenced.
Register in Form 35 to record the names of specially trained adult workers.
Section 22. Work on or near machinery in motion.
It shall be examined by qualified adult male worker.
Section 23. read with rule 54: Employment of young person on dangerous
machine
Employment of young persons in dangerous machines unless they are fully
trained and sufficiently instructed.
Section 24. Striking gear and cutting off power.
Efficient mechanical appliances shall be provided.
Suitable devices for cutting of power in emergencies from running machinery
shall be provided and maintained.
Section 25 – Self acting Machine
No traversing part of a self acting machine shall be allowed to run on its outward
or inward traverse within a distance of 45 centimeters.

Section 26 – read with Rule 54A – Casing of new machinery


In all machineries driven by power and installed in a factory.
every set of screw, bolt or key of any revolving shaft, spindle or wheel shall be duly
safeguarded.
Section 27 – Prohibition of employment of women and children near cotton
openers.
No woman or child shall be employed in any part of a factory for pressing
cotton in which a cotton opener is at work.
Section 28 read with Rule 55. Hoists and Lifts (raise by some mechanical
appliance)
Every hoist and lift shall be of good mechanical construction, sound material
and adequate strength, properly maintained and thoroughly examined by competent
person at least once in six months.

Section 29 – read with Rule 55A
Lifting machines, chains, ropes and lifting tackles (ropes for pulling weights). In
every factory every lifting machine, chain rope and lifting tackle should be of good
construction, sound material and adequate strength free from defects shall be
thoroughly examined and properly maintained. Examined by competent persons at
least once in a year.
Section 30 – Revolving machinery
In every factory in which the process of grinding is carried on there shall be
permanently affixed to and placed near each machine in use a notice indicating the
maximum safe working peripheral speed of every grind stone and abrasive wheel.
Section 31 (Pressure Plant) read with rule 56 & 56A
In any factory, any plant or machinery or any part thereof is operated at a
pressure above atmospheric pressure, effective measures shall be taken to ensure that
the safe working pressure of such plant and machinery or part is not exceeded.
Section 32 floors, stairs and means of access :
In every factory all floors, stairs, passages and gangways shall be of sound
construction and properly maintained with substantial hand rails.

Section 33 – Pits, Sumps, openings in floor etc.
In every factory every fixed vessel, sumps, tank, pit or opening in the ground or in
a floor, which, by reason of its depth, situation, construction or contents, is or may be a
.
source of danger, shall either be securely covered or securely fenced.
Section 34 read with Rule 57.
Excessive weights.
No person shall be employed in any factory to lift, carry or move any load so
heavy as to be likely to cause him injury.
Rule 57
No man, woman or young person shall lift, carry or move by hand or on head, any
material, article, tool and appliance exceeding the maximum limit as set out hereunder.
Adult male - 50 kg.
Adult Female - 30 kg.
Adolescent male - 30 kg.
Adolescent female - 20 kg.
Male child - 16 kg.
Female child - 13 kg.

Section 35 read with Rule 58.
Protection of eyes.
Any process involving risk of injury to the eyes from particles and pigments thrown off
in the course of process or risk to the eyes by reason of exposure to excessive light, there shall
be effective screens of suitable goggles provided for the protection of persons employed on, or
in the immediate vicinity of the process. (To follow schedule I & II)
Section 36 read with rule 59.
Precautions against dangerous fumes, gases etc. No person shall be required or allowed to
enter any chamber, tank, vat, pit, pipe, flue or other confined space in any factory in which any
gas, fume, vapour or dust is likely to be present to such an extent as to involve risk to persons
being overcome thereby, unless it is provided with a manhole of adequate size and other
effective means of egress.
No person shall be required or allowed to enter any confined space until all practicable
measures have been taken to remove any gas, fume, vapour or dust and a certificate by a
competent person has been given in writing based on a test carried out by himself that the
space is reasonably free from dangerous gas, fume, vapour and dust or such person is wearing
suitable breathing apparatus and belt securely attached to a rope.

Rectangular or oval shaped - 40.6 cm x 30.5 cm
Circular shape – 40.6 cm in diameter.
SAFETY
Section 36A – Precautions regarding the use of portable electric light
No portable electric lift or any other electric appliance of voltage exceeding 24
volts shall be permitted for use inside any chamber, tank, vat, pit, pipe, flue or other
confined space unless adequate safety devices are provided.

Section 37 read with rule 60.


Explosive or inflammable dust, gas etc., where in any factory any manufacturing
process produces dust, gas, fume or vapour of such character and to such extent as to
be likely to explode an ignition, all practicable measures, shall be taken to prevent
any such explosion by

Effective enclosure of the plant or machinery used in the process.

Removal or prevention of the accumulation of such dust, gas, fume, and vapour;

Exclusion and effective enclosure of all possible sources of ignition.

Precautions in case of fire.
In every factory, all practicable measures shall be taken to prevent outbreak of fire and its
spread, both internally and externally, and to provide and maintain – Safe measures of escape
for all persons in the event of fire and the necessary equipment and facilities for extinguishing
fire.
Effective measures shall be taken to ensure that in every factory all the workers are familiar
with the means of escape in case of fire and have been adequately trained in the routine to be
followed in such cases.
The State Government may make necessary rules in this regard.
The Director of Industrial Health and Safety, may by order in writing, require that such
additional measures be provided in the factory within certain dates.
Rule 61
Fire protection.

Protection against ignition.
Fire exits.
Fire fighting arrangement.
First aid fire fighting equipment.

Section 39 – Power to require specifications of defective parts of tests of
stability.
If the Inspector has reason to believe that any building or part of building or part
of the ways, machinery or plant in a factory is in such of condition that it may be
dangerous to human life and safety, he may require the occupier or manager.
to furnish such drawings, specifications and other particulars as may be necessary
and
to carry out such tests in such manner as may be specified in the order.
Section 40 – Safety of buildings and machinery.
If it appears to the Inspector that any building or part of a building or any part of
the ways, machinery or plant in a factory is in such a condition that it is dangerous to
human life or safety, he may serve on the occupier / manager an order in writing
specifying the measures to be taken at once or he may order prohibiting its use until it
is properly repaired or altered.
Section 40 A - Maintenance of building
If it appears to the Inspector that any building or part of a building in a factory is
in such a state of disrepair as is likely to lead to conditions detrimental to the health
and welfare of the workers, he may pass an order specifying the measures to be taken
at once.

Section 40 B read with Rule 61AA. - Safety Officers.
1000 or more workers are ordinarily employed.
Wherein any manufacturing process involves any risk of bodily injuring, poisoning
or disease or any other hazard to health to the persons employed.
The employer shall employ such number of safety officers as may be specified.

Rule 61 AA - Duties, qualification and conditions of service of safety officers.


(a) A degree in a branch of engineering or technology with practical experience in a
factory in a supervisor capacity for a period of not less than two years or a member of
the Institute of Engineers (India), or a recognized degree in Physics or Chemistry and
has a practical experience of at least five years or a recognized diploma in any branch
of engineering or technology with not less than five years of experience.

Possess a degree or diploma in Industrial Safety recognized by the State Government.


has adequate knowledge of the language of the majority of workers.

(b) A degree or diploma in engineering or technology with at least five years of


experience in Central or State Government (Factories) or Indian Docks.
SAFETY
(2) Conditions of Service :
If more than one, then one of them shall be a Chief Safety Officer with the status
higher than that of others – i.e. in the status of a Senior Executive with the same scale
of pay.
His appointment shall be notified to the DISH.
In the case of dismissal or discharge, he has a right to appeal to the State Govt.
(3) Duties of Safety Officers :
To advise and assist the management in the fulfillment of its obligation,
statutory or otherwise, concerning prevention of personal injuries and maintaining a
safe working environment.
To advise the concerned department in planning and organizing measures
necessary for the effective control of personal injuries.
To advise in safety aspect in all job studies and to carryout detailed job safety
studies of selected jobs.
To check and evaluate the effectiveness of the action taken or proposed to be taken
to prevent personal injuries.
To advise the purchasing and stores department in ensuring high quality and
availability of personal protection equipment.
SAFETY
Duties of Safety Officers
To advise on matters relating to plant safety inspections.
To carryout plant safety inspections.
To render advise on matters relating to reporting and investigation of industrial
accidents and diseases.
To investigate the cases of industrial diseases contracted and dangerous occurrences
reportable under rule 96.
To advise on maintenance of records on safety.
To promote setting up of safety committees.
To organize in association with the concerned department, campaigns, competitions,
contests, and other activities which will develop and maintain the interest of the workers
in establishing and maintaining safe conditions of work and procedure and
to design and conduct suitable training and educational programmes for the prevention
of personal injuries.

(4) All facilities, equipment and information shall be provided to him.


(5) No safety officer shall be required or permitted to do any work which is inconsistent
with or detrimental to the performance of the duties prescribed above.
PROVISIONS RELATING TO
HAZARDOUS PROCESSES

[CHAPTER IV A]
Section 41 A – Site Appraisal Committee
Advising for grant of permission for the initial location of a factory involving a
hazardous process or for the expansion of any such factory.

Section 41 B – Compulsary Disclosure of Information By The


Occupier
a)The occupier of a hazardous process factory should disclose the following to
workers and Government:
i. Dangers including health hazards
ii. Measures to overcome such hazards
While :
- Handling
- Manufacture
- Transportation
iii. Quantity, specifications and characteristics of wastes and the manner of
their disposal.
b)Detailed health and safety policy.
c)On-site emergency plan.
Section 41 C – Specific Responsibility of The Occupier
Maintain up-to-date health records of the workers.

To appoint qualified and experienced persons in handling hazardous substances


and supervision.

Section 41 F – Permissible Limits of Exposure of Chemical And


Toxic Substances
The maximum permissible threshold limits of exposure of chemicals listed under
second schedule should never be exceeded.
Permissible limits of exposure.
Time weighted average concentration (TWA) , - 8 hrs.
Short-term exposure limit (STEL), - 15 min.in ppm and mg/m³
Section 41 G
Workers participation in Safety Management

Safety committee in hazardous process industries.

Section 41 H - Right of workers to warn about imminent Danger


- In hazardous processes, the supervisor should take immediate remedial
action of any apprehension of imminent danger is brought by the workers.

- If he is not satisfied about the existence of imminent danger he must refer to


it to the concerned Factory Inspector.

Section 87 – Dangerous Operation


Manufacturing process or operation which exposes the worker to a serious risk of
bodily injury , poisoning or disease.
The following operations when carried on in any factory are
declared to be dangerous operations under section 87

1.Manufacture of aerated water and processes incidental thereto.

2. Electroplating or oxidation of metal articles by use of an electrolyte containing acids,


bases of salts of metals such as chromium, nickel, cadmium, zinc, copper, silver, gold,
etc.

3. Manufacture and repair of electric accumulators.

4. Glass manufacture.

5. Grinding or glazing of metals.

6. Manufacture and treatment of lead and certain compounds of lead.

7. Generation of gas from dangerous petroleum.

SECTION 88 - NOTICE OF ACCIDENTS
Accident which prevents the injured from work for 48 hours, should be notified to the
Inspector.
SECTION 88 A - NOTICE OF DANGEROUS OCCURRENCE
Report within 12 hrs of the occurrence.
Bursting of a steam plant.
Collapse of a crane, derrick, winch and hoist.
Explosion, fire, leak or escape of hot metal.
Explosion of receiver or container at a pressure above atmospheric pressure of any
gas.
Collapse of any floor, gallery, roof, bridge, chimney, wall or any structure.

Penalty for contravention of the provisions of sections 41 B, 41 C


and 41 H. –
(1) Whoever fails to comply with or contravenes any of the provisions of
sections 41B, 41C or 41H or the rules made there under, shall, in respect
of such failure or contravention, be punishable with imprisonment for a
term which may extend to seven years and with fine which may extend
to two lakhs rupees, and in case the failure or contravention.
