ETHICS AND PROCEDURES


Australian copyright law

■ In Australia, copyright is an automatic right so it does not need to be registered.


The Copyright Act 1968 (Cth) regulates copyright in relation to original literary,
dramatic, musical, artistic works, and other subject matter. Under section 31, copyright
owners have rights to:
• Reproduce the original work;
• Publish the work;
• Perform the work in public;
• Communicate the work to the public; and
• Adapt the work.
Organisational copyright requirements

■ copyright to subsist:
1. there must be an expression of ideas in a literary, dramatic, musical or artistic work, or
in subject matter other than works, such as in an audio-visual performance
2. the work must be original
3. the work must be recorded in a 'material form', for example, written down on paper or
something else
4. there must be an author or artist.
Copyright checklist

■ Ensure that application is enclosed with prescribed fee by postal order or Demand Draft only in
favour of ‘Registrar of Copyrights’ payable at New Delhi.

■ The application (Form XIV) including the Statement of Particulars (SoP) and the Statement of
Further Particulars (SoFP) should be signed by the applicant only.

■ Under Copyright amendment Rule, 2013, the applicant required to send by registered post copies of
Form (XIV), SoP & SoFP to every person who claims or has any interest in the subject matter of the
copyright or disputes the rights of applicant to it.

■ Application should contain Form (XIV), SoP & SoFP and should be submitted single copy.

■ Strive to increase the competence and prestige of the profession, and

The personal commitments set out in NR4.3 and NR4.4 bind each member with regard to that member's
professional conduct.

employers, employees and students. I acknowledge:

■ Priorities: I must place the interests of the community above those of personal or sectional interests.
■ Competence: I must work competently and diligently for my clients and employers.
■ Honesty: I must be honest in my representations of skills, knowledge, services and products.

The guidelines are intended to ensure that staff and contractors of NICON Software Pt. Ltd will deliver services in
accordance with ‘Our Purpose’ and the following principles:

 Staff and contractors should perform their duties with professionalism and integrity.

 Staff and contractors should effectively and efficiently serve our Clients.

 Fairness and equity must be observed by our staff and contractors in dealings with Clients and stakeholders.

 Real or potential conflicts of interest are to be avoided.

■ Policy Statements: NICON Software Pt. Ltd is committed to maintaining a Code of Conduct and
Ethics that outlines the standards of behaviour expected of staff and contractors; their rights; and
ethical standards expected of them to promote sound professional behaviour in order to
safeguard the welfare of our Clients and the integrity of NICON Software Pt. Ltd.

Our organisational values, moral imperatives and ethical principles will form the basis for the
development of this code.

Failure to adhere to the Code of Conduct and Ethics can result in disciplinary action that may lead to
the termination of employment and/ or contractor work with NICON Software Pt. Ltd.
Privacy policy and procedures

■ Procedure: The Chief Executive Officer in consultation with the Leadership Team will issue and
maintain a Code of Conduct and Ethics that will apply to all NICON Software Pt. Ltd staff and
contractors.

■ Performance Standards:

All staff and contractors fully understand and comply with the Code of Conduct and Ethics.

All staff and contractors have access to the Code of Conduct and Ethics.

Tips to maintain integrity, confidentiality, security
and availability of information.

■ Use preventive measures such as redundancy, failover and RAID. Ensure


systems and applications stay updated.
■ Use network or server monitoring systems.
■ Ensure a data recovery and business continuity (BC) plan is in place in case of
data loss.
